    Good luck, they don't half like to drag it out don't they?! That Heidi is so vague in her answers, think she should have been a politician! :rotfl: My letter from the FO did state that they bank had told them that it could take up to 6 wks (why, I sure don't know!) but no-one has told me a time scale, even saying it could take that long! Will they chance their arm and not pay out riding on the back of this test case debarcle?!!
    Anyway, hope you get on ok, keep us posted.

    I'm getting a little worried now as I have read on other posts that HSBC have had warrants stayed! I was going to apply for a warrant today (well, I still am!) if they haven't paid up by 4pm, which they have told me they have no intention of doing.

    You're right about Heidi...she has taken to ignoring my messages now, very professional! :rotfl:

    received a letter from the banks solicitors today saying they are applying for my judgement by default to be set aside :(

    they said that due to administration errors, they did not enter the defence in time

    Hi

    Why were you given a judgement by default? was it because they didn't get their defence in within the given time?

    If I were you I would beat them to it and speak to the court and tell them what the bank have said (send it in writing) and copy the bank it. They are simply using delay tactics and trying to scare you into not fighting on - don't give in! If you were given judgement then that is legally binding and if they don't stick to that I would push the judge for a court date and make the bank show up and give their defence.

    I had a court date for 22nd August that was cancelled because the court gave me judgement because HSBC didn't enter their defence on time. I just don't see how the banks can abuse the system and get away with it?

    Come on Martin - there must be some advice you can give us here?????

    Well that's their problem and not yours!! If you hadn't entered your claim on time then it would have been struck out with no questions asked, but because the banks are abusing the system and getting away with it they obviously think that they can disregard the law and make it up to suit them...it makes me soooooooooooooo mad! :mad:

    You could phone as well I guess, but make sure you write too so that you have it all documented if you do end up with your day in court. By copying in the bank you show that you mean business too - might not get you very far with them, but again shows the court that you have kept them informed of the action you are taking.

  • Does anyone have the phone number handy for HSBC's solicitors (D&G I seem to think??) I'm having no joy with the bank themselves so I may as well speak to them...
