 Trying to reclaim approx £4400 inc interest from HSBC. Just received ack from court saying they have 28 days to prepare defence. They have appointed solicitors who 'intend to defend all of the claim'.
What do I do next?
Seems to me from reading this forum that most people have been paid out by now, just my luck. Do you have to appoint a solicitor to represent you in court? How do you proceed from here?

Hi All. I had a goodwill settlement letter of HSBC over two weeks ago. I Decided to accept the offer of my claim minus the bank charges. They received the letter by registered post 14 days ago and the money should have been paid into my account today. I received another letter today saying that they were making me aware of the the new OFT situation and that I would have to sign another form accepting the offer again and wait another 14 days?? Is this correct even though they have received a signed copy of my acceptance 14 days ago? Arnt they reneging on the proposal that they put forward? Any views would be appreciated
P.S. I cant spell!:D0 -
 We refer to your complaint on bank charges. We believe that your complaint concers the level, fairness or lawfulness of the charges....
We do not agree that our charges are in any way unfair or unenforceable. (Would kindof defeat the object if you did really)
Since we last wrote to you, the bank (with several others) has become involved in legal proceedings with the OFT on bank charges which we believe will resolve the legal issues about the fairness and legality of your bank charges.
....until the determination of the legal issues in the above proceedings we have asked the Financial Services Authority to suspend the normal timetable for dealing with bank charge complaints, the FSA has agreed to this request subject to conditions that protect your rights. (which are?)
We can assure you we have registered and stored your complaints (yeah right) Please retain your bank records as this will amke it easier for you to support your complaint on resolution of the test case. Once the legal proceedings between the OFT and the banks finish, we will resolve your complaint as quickly as possible. (By then you will owe me more money so thats fine by me!)
We are sorry we have not been able to respond in full to your complaint now...(saving you £200million i bet you're sorry)
OBVIOUSLY exactly what will happen next will depend on the courts. We do not know how long the case will take - we have promised to proceed as quickly as possilbe but INEVITABLY, given the importance of the issues being considered, this may take many months to finally resolve....we can assure you once the legal proceedings are completed we will resolve your complaint as quickly as possible...(Did you not just say that?)
blah blah blah
Yours sincerely

Had a bit of luck today went to the bank on the off chance that they could print me the 2nd acceptance letter out! they did so now have the letter and sent back today by fax. So I should receive my money on the 28th I think! about time.
Why don`t you try and do that if you still havn`t received your letter go to the branch and ask them to print it for you, there is not much change with the wording only that they have included the information on about the bank taking a test case to court blardy blardy blah! you have 2 months to consider the offer etc etc.
Hope this helps hun.

Hiya,
Yeah I got my letter yesterday (I'd been out all day and missed its arrival and then got home too late to post it back!) I couldn't see much change in the wording at all!
I figure it's just another way of them just hanging on to our money a little bit longer!!
Anyway, I sent it back today Special Delivery and so it should be in my account by the 29th (unless of course they come up with another stalling tactic!!)
I know I should just appreciate the fact that I am getting it unlike some poor souls out there who have to wait ages, but it's hard when you're expecting it to be paid in and then you're told you have to wait even longer!!!
Ho hum...... At least it'll be there by the end of the month!
Thanks Bingobella you are just about keeping me sane!!

Hi Lou,
The sofas are lovely! Really comfy!!
Kids have driven me crazy today - it's ironic, you feel guilty being at work while they're off, but if you take time off to be with them they drive you potty!!! It doesn't help that the weather's gone pants again......
How's you? Hope you're doing ok!0
