Hi All. I had a goodwill settlement letter of HSBC over two weeks ago. I Decided to accept the offer of my claim minus the bank charges. They received the letter by registered post 14 days ago and the money should have been paid into my account today. I received another letter today saying that they were making me aware of the the new OFT situation and that I would have to sign another form accepting the offer again and wait another 14 days?? Is this correct even though they have received a signed copy of my acceptance 14 days ago? Arnt they reneging on the proposal that they put forward? Any views would be appreciated
P.S. I cant spell!:D
My gf is in the same position, as are many others. Basically they are offering you the chance to wait to see the oft's decision or take the original offer. This is because once you take the offer they won't repay the difference if the OFT decide that the banks are in the wrong and have to pay back 100% of what they took. You will still get your money its just taking a little longer. Fingers crossed you get it soon. My gf sent her letter back a while ago, and was told that the new style (?) acceptance form had been sent out a few days ago, but no sign of it yet.

Still waiting!!!!!!!! :mad: Getting to the self combusting stage! :rotfl: Sent an e mail to them to ask when my money will be in my account, (they received the letter from the FO 7th Aug) and all Heidi said "I can confirm your query is with the relevent department and will be sorted"!! "QUERY!???? It's not a query love it's a fact, when's it gonna be?!! HSBC are so full of [EMAIL="c@@p"]c@@p[/EMAIL] sometimes! .................See - I've started to self combust :j :eek:
O well, least I'll be getting something! (Hopefully, you never know with them!)

This is exactly what happened to me and a few others too. It's really annoying!
Not sure what the legal rights are, but it seems to me like they are really covering their backs for if or when they lose the test case.
What annoyed me is that they waited till the 14 days were almost up before sending out the other letter. I sent mine back yesterday special delivery (they will get it today) so the money should be in on the 29th August.
It is a pain, and I didn't have time to look into the legal side (if you do I'd be interested to know!) but I'm still just grateful that I'm not having to wait until after the test case.

I sent HSBC a letter claiming all bank charges on the 12th June 07, they then sent a letter on the 20th June asking me for a breakdown of all charges I was claiming. I then sent them this on 11th July and after that the court case was announced. I called them and was told on the phone that my case wouldnt be dealt with. I received the officail letter telling me this today! What do you think I should do now? To complicate matters further I did not originally claim for 'total charges' and also since the original claim have incurred another £400 in charges. So the claim is now much higher than the original £1400!

My bank has written to me saying they will not (with permission of FSA) look into my complaint any further until the case outcome is known. They said they have filed it away and wont do any more until this time. However they seem quite happy to carry on defaulting my accounts due to this error.
Thing is all i asked was for them to remove/look into charges that they put on because they wouldnt cancel a DD.
My complaint is charge related as i wrote to complain about them not stopping the DD even when i have another account i wanted it to go from so in turn everytime it went from an account iwas trying to close £75 went on, i asked no less than 12 times for them to cancel it and cancelled it online but they restarted it everytime. Are they just trying it on trying to relate my complaint to the impending case ?0 -
Ive had a similar thing really dont know what to do, or whether they can do it. hopefully someone will come along and answer for us soon0

I know its very complicated. I have read messages that say HSBC have given them an offer even after the waiver and yet others they are not, dont know how they decide who to pay and who not to!0

How annoying! I'm in a similar position - the HSBC didn't enter their defence so the court struck it out and awarded me full claim. They were ordered to pay in full by 4pm tomorrow. I have contacted them and they say they never received anything from the court and I quote the lovely Heidi 'wait 2 or 3 days to see if we receive anything' considering the court sent the letter 10 days ago, I doubt 2-3 days is going to change them having received it or not.
Anyway, to help them out I have emailed them the court order and also suggested that if they give me a fax number I will fax it them to 'help them comply with the court order' guess what, no reply!!
I'll be at the court at 1605 tomorrow to issue a warrant, which is quite scary but I don't care! :mad:0 -
Help!! (please) went for charges totaling around £2700 with my hsbc business account took months eventualy spoke to a big cheese at hsbc he baffled me with financial jargon (rubbish) then offered me £1071 i got a formal letter offering me this 2 days later.Was in the proccess of thinking about weather to except when this morning i received a letter from hsbc from someone completely differant saying they can not procead with the case as thay have not got the right information
they have a list stating everthing it says on my statemants relavant to charges over the last 6 years.I would really appreciate any help thanks..0
