Crazy logic but here goes...
The banks have been told they can freeze all claims if they desire - what about if they wish to use their discretion and process some in the meantime? Is it really that unlikely?
Regardless of the outcome of the test case they are going to accrue a shed load more complaints in the 12 months, 18 months whatever months this is going to take to go through the motions. They could apply the same sort of discretion the circuit judges may apply i.e not necessarily freezing every case but judging each case on its merits. Do they really want possibly half a million claims to be stored on ice accruing more interest (and I do beleive we should fight for this as they have peeing about with us for so long..) whilst the test case is running through? Maybe it won't bother them in the slightest may be it will. They could just hedge their bets and make offers on settlements now rather than risk paying millions out more in X amount of months times with all that stashed swag of cash they have been charging wrongly. I am forever the optomist!!!!:rotfl:
I may just have stepped of the plane from cuckoo land and feel free to tell me so but I am determined to play this this supposition to the hilt. Who knows it might pay off!

Oh well, end of my case. Phoned Cardiff Courts and all proceedings are suspended until they get feedback from the Magistrates in London. :rolleyes: :rolleyes:
I was due in Court on the 14th August. I'll just have to wait and see what happens.0 -

Despite my experience below, HSBC are still saying they intend to honour their orignal offer to me. What really disgusts me is that they have "lost" both my original acceptance forms sent 10th and 11th July and any new ones they say they're sending out are either wrong or don't arrive!!!

Thought I was having real success with HSBC. I was claiming back for two accounts just over £3000 for each including interest. They offered about £2500 for each so I decided to accept. This is where the problems started, it's getting complicated so I'll list the scenario:
1. Signed and returned acceptance forms, both arrived a day apart so were returned a day apart on 10th and 11th July 2007
2. Followed up with a phone call a week later, neither form had been received or processed, according to HSBC.
3. I asked for new acceptance forms to be sent out. This would be 17th July.
4. One never arrived and one was for a new amount, £729 less than they had already offered.
5. Phoned up and they agreed to send new forms with correct amounts out.
6. I rang up two days letter and asked them to confirm the amount on the acceptance forms they were sending out. The confirmed it was the same amount, i.e still £729 less. This was 2nd August.
7. Still no sign of orignal forms sent or new ones sent to me!
8. Blew my stack repeatedly on phone. I'd kept photo copies of orignal acceptance forms and still have the original letters. They agreed I could fax these over. Did this yesterday (6th August)
9. Just phoned up to check these had been received and they are now saying that after 27th July 2007 they can't accept original acceptance forms as they need to include new legal wording to reflect outcome of the recent court case.
10. Blew stack again, and in style this time. They have assured me (again) that new acceptance forms with correct amounts are being sent out today (7th August)
11. I'll phone up on Thursday and check but after that I'll have to go up to their office in and shout at someone!
Sorry for the ramble but what can I do. I'm wasting so much time, money and energy on this. Has anyone else experienced this? I desperately need this money and I'm getting visbly stressed over this stupid game they seem to be playing. I suspect they are delaying on purpose to await the outcome of any cases but they assure me that they are honouring all offers to date.
I would appreciate any advice on this please.

That has got to be so stressful for you, they are in fact honoured to meet their offer as it was before the test case announcement.
I know a few others have had trouble receiving their offers through the post and have arranged to go into their local hsbc and have the offer letter printed off there.

Hey thanks Lou - it's been a bit of a nightmare.
I tried going into my branch last week when the original forms weren't received. The were unable to access my folder from the branch - the main one in Westminster! This was when they said they would send out the new acceptance forms.
I will try again once I know the letters are on the system.
I'm aware that they have to honour their offer so I know I'll get there but this has been the worst customer service experience I've ever had. I'll close my accounts down once it's all sorted.
I do believe they are getting familiar with me now at the call centre!
Will be worth it though!

I have been checking in - but it all went so quiet.....
It's day 11 for my second claim - wonder if it'll be lucky 13 again!!!:T :T
Can't wait to get rid of HSBC, I'm glad we've got our money back but their customer service is just pants!!!:mad: :mad: We are in the process of moving to Alliance & Leicester - don't know if they'll be any better, but at least they have UK call centres!!
