    Well 8 weeks settlement was up on Friday, so on saturday i recieved a letter from the bank stating that the have put my case on hold until the OFT answers come out from the "Test Case". Can anyone help, i am due in court (Cardiff) on the 14th August, will this still be going ahead? or do i need to contact the courts? or will HSBC do this?

    Answers or advice would be much apprciated.

    Guys, anyone heard of this? I received an offer from my bank which I agreed to and sent back about 3 weeks ago. Called today as I was a bit nervous with the new test case issue. The bank said I can still have the charges, but because of the new test case and freezing of claims, their terms have changed and they have to send me a new offer and letter to sign. I thought what I signed was some form of contract and was binding (hence the signing :confused: ) Has this happened to anyone lse? If so what delay did it mean for you? Thanks guys

    My first post. I sent my first letter reclaiming my charges from HSBC on 17 July, before the OFT announcement. I got a standard reply back (with the leaflet) a few days later. Since in the letter I asked them to come back to me in a satisfactory way within 14 days, and they obvioulsy haven't, I sent a second letter threatening with Court Action, but this is AFTER the OFT announcement on August 3.

    I suppose they will not reply now? I am thinking of just pushing it through to the courtroom and exercise my LEGAL RIGHT to prosecute.

    I think the OFT waiver goes against the groundlaw, and I therefore will ignore this. I am sure I can exercise my basic legal rights successfully in a courtroom? Any suggestions, anyone?
  • Hi Guys,

    Still not received a copy of the offer letter in the post either Royal Mail`s Fault or HSBC. More like HSBC!!!!

    Spoke to a lady in leeds which told me to go to my branch today and ask them to print a copy of the letter and fax it back over to them today.

    Just faxed it off this minute so should receive my money within 14 days!!! roll on the 19th August !

    Woo Hoo! finally getting somewhere!

  • Do NOT agree signing a new agreement!!!! They cannot change terms after a signature. Of course they are trying everything they can NOT to pay you out. What they're doing now is illegal.

    Hiya,

    My court date is the same, all our claims have been stayed which were due to be heard on 14th august. Get yourself over to the CAG forum and take a look at the HSBC thread, there are about 600 of us who have the same date as you. A large number of them have threads open on the CAG forum. We have been advised to send off an application for removal of the stay. Everything is explained on CAG!

    Hi, I am having a bloody good bash at trying to appeal this stalling malarky. See post 330. I may well be wasting my time but nevertheless it will stop me from going nuts in the meantime. Oh how I wished I had started my claim just a few weeks earlier!!

    Crazy logic but here goes...

    The banks have been told they can freeze all claims if they desire - what about if they wish to use their discretion and process some in the meantime? Is it really that unlikely? :confused:

    Regardless of the outcome of the test case they are going to accrue a shed load more complaints in the 12 months, 18 months whatever months this is going to take to go through the motions. They could apply the same sort of discretion the circuit judges may apply i.e not necessarily freezing every case but judging each case on its merits. Do they really want possibly half a million claims to be stored on ice accruing more interest (and I do beleive we should fight for this as they have peeing about with us for so long..) whilst the test case is running through? Maybe it won't bother them in the slightest may be it will. They could just hedge their bets and make offers on settlements now rather than risk paying millions out more in X amount of months times with all that stashed swag of cash they have been charging wrongly. I am forever the optomist!!!!:rotfl:

    I may just have stepped of the plane from cuckoo land and feel free to tell me so but I am determined to play this this supposition to the hilt. Who knows it might pay off!
