Hi guys/gals
The court have just written to say HSBC bank have filed a defence and we have now been sent an AQ to complete (and cough up a further £100). In the letter attached from HSBC they say :
a) they are entitled to (according to the T's and C's) make charges for their services such as overdraft review fee etc
b) they deny that the charges are penalties at common law or unfair terms
c) they claim charges are reasonable and fully disclosed in the T's and C's and that the UTCCR's are not applicable to them. They claim the charges are not default charges and therefore cannot amount to a penalty.
The charges we claimed for are related to a joint current account with an overdraft facilty.
We do not really understand the jargon in their defence letter and wonder if anyone can advise if we should be concerned!??

Nothing at all to worry about. Just a standard response letter to your claim. I think everyone has had this when they have gone as far as court. Keep going and good luck.;)

Is there a contact number for HSBC?
I have started the ball rolling for 2 of my wife's accounts. They signed for the statement request letters on 22nd June, but the cheques have not left my account and we have heard nothing so far.
Do they normally take so long? I did this for the Natwest & the statements arrived within 2 weeks.

The number you need to call is 08456 028006 which is the number for the service centre in Leeds.
You should be able to access your last 6 years bank statements online if you have access to internet banking.

I m still on here, can t resist logging in each day!!! Paid off a few more bills this morning, kids are on hols and already they ve started arguing and fighting (only six weeks to go) lol.

The waiting is the hardest, its a brilliant feeling when you get offer, but then its the 14 day wait for it to then get to your account that i found so infuriating. Combusted on numerous days on here.:rotfl:

18th July - Received letter stating they are looking into matters (response in 8 weeks)
What should I do next..?
It is obvious they are wasting as much time as possible.
The amount is £1035 (inc. interest)...
I would like the full amount back or as close as possible but would like the issue resolved asap.
Help me veterans

Welcome:T ,
Hsbc always state they will respond within eight weeks generally with an offer around 85% but will not pay the interest from what i can see you have waited around 4 wks, so have about three weeks before you should start chasing them. This way has proved very successful for many of us on here, generally a very large claim for £3k plus maybe result in them saying NO then its a matter of taking the court route.
You are in a position now to take it to court which will get your the full amount plus interest but this can take months, as the courts are extremely busy with all the claims.
The decision is yours really, if you want the money back asap then i suggest you wait the eight weeks. But it really is up to the individual.

On a slightly better note, I did find out today that the money claimed and accepted for my other account should be in the bank by 3rd August :T so at least that's something!!

Hi, just a thought, but do you have a fax machine? You could ask them to fax your offer, then fax it back. It could save loads of time, especially with postal strike!

I did post an update later yesterday to admit to my almost (very) foolish mistake of throwing away my offer letter which had become entangled with some junk mail!!:eek:
I have now sent the reply back via special delivery so just hoping it arrives there in time!

Just a quickie...... has anyone tried faxing to accept a non-court offer acceptance letter to HSBC. Sent my acceptance letter in post today, but kept a copy. Just wondering whether it would be worth faxing it too....could it actually speed things up????0

I can't resist it either! My kids haven't been too bad at the moment. My daughter has a bad throat so she is fairly quiet and my son has been swimming all afternoon, they only finished today. They are off to my mum and dad's next week to stay so I have some peace :j We're off to Devon the week after, are you going away?
Haven't had nothing back on email yet but I will be ringing first thing Monday morning to make sure my offer is on the way!!! Actually I might even ring on Friday. They are charging me another £50 on 28/7 so I'm going to chuck a claim straight in for that!! :rotfl: Are you claiming for more charges?
