  • I'm currently awaiting my offer letter, it's been 4 weeks and it's starting to drag on a bit...I can't stand the waiting.

    First letter sent: 25/06/07
    'We're investigating...' reply received: 27/06/07
    Email enquiring how claim was going: 10/7/07
    'Will take 8 weeks' reply: 11/07/07
    Awaiting not so patiently 25/07/07
    All Proceedings Halted 28/07/07

    Hsbc will take up to 40 days for statements

    hsbc will take about a wk to acknowledge first letter then they will make you an offer around about eight weeks if you want to wait, or you can proceed after two weeks withsecond letter threatening court action , this will generally take months longer if you take the court route as they will see it through sometimes right upto the court date and at the moment the courts are extremely busy. but this way you will get the whole amount back plus interest.

    If you all have a read back through you will be able to see what alot of us have done and this is wait the eight weeks we have generally got back about 85% of our claims.

    If you have online banking you can get all your statements from on there, luckily hsbc are one of the few banks which allows you access to six years of statements. They generally take 40 days for sending out statements.

    Hi ya

    Same as me then, i ve just received payout but am expecting charges due to going overdrawn by £20 for a few days (a direct debit came out which wasn t suppose to) so i might be claiming them back. I think you ll find that they will payout, but will then close your account as its the second claim. If you have an overdraft you will more than likely have to pay that off, so if the charges that you are claiming second time don t amount to the same as your overdraft you will be out of pocket. You need to weigh it up really.

    They withdrew my switch card before I got my acceptance offer. I still have the overdraft. The charges that I have incurred are 875 pounds, more than my overdraft.

    Not sure what to do next as there are a few avenues to go down...

    29th June - Sent 1st letter (requesting charges + interest)

    13th July - Threatened court action as no response arrived

    18th July - Received letter stating they are looking into matters (response in 8 weeks)

    What should I do next..?
    It is obvious they are wasting as much time as possible.
    The amount is £1035 (inc. interest)...
    I would like the full amount back or as close as possible but would like the issue resolved asap.

    Hi

    I desperatly need some help. I bank with the HSBC Bank, i sent my first letter on 7th may 07 for the sum of £4336.00 + £1017.33 Int on my one account for 6 yrs of overcharges, and then sent a letter on the 9th May for my other account with them for £2404.50 + £443.82 interest. I heard nothing back at all, i sent my second letters 2 wks after threatening court action, still nothing. I didnt have the money for a few wks to start the court action but i did on the 30th June for both accounts, on 3rd July i recieved my first letter from the bank saying that the BANK DOES NOT AGREE THAT THEIR CHARGES ARE IN ANY WAY UNFAIR OR UNENFORCEABLE. THE CONTRACT BETWEEN THE BANK AND ITS CUSTOMERS IS GOVERNED BY THEIR PERSONAL BANKING TERMS AND CONDITIONS.

    They said they hope i am happy with their response(which i'm not obviously) if i wish to esculate my concerns to the next stage i need to put it in writing within the next 8 wks to the address they gave me. Do i contact them as i have already started court proceedings or do i just leave and wait for my court hearing ?????? Need help desperatly:confused:

    hi ya

    As you ve already started court proceedings you need to phone them and let them know you are not satisfied with their response and that you have already started court proceedings. Follow this up by a letter sent recorded delivery. I think you ll find that they will now follow the court timetable before they pay out but it might be worth in your letter stating an amount around the 85% mark without interest on each account that you are willing to settle for, (without prejudice) if they don t offer you this and it does go to court it will show in your favour that you have tried to be reasonable and meet them half way. Good luck remember though it will take time and lots and lots of patience:rotfl: but you will get your payout as they always pay out in the end.

    Hi guys/gals
    The court have just written to say HSBC bank have filed a defence and we have now been sent an AQ to complete (and cough up a further £100). In the letter attached from HSBC they say :

    a) they are entitled to (according to the T's and C's) make charges for their services such as overdraft review fee etc
    b) they deny that the charges are penalties at common law or unfair terms
    c) they claim charges are reasonable and fully disclosed in the T's and C's and that the UTCCR's are not applicable to them. They claim the charges are not default charges and therefore cannot amount to a penalty.

    The charges we claimed for are related to a joint current account with an overdraft facilty.

    We do not really understand the jargon in their defence letter and wonder if anyone can advise if we should be concerned!??

    It certainly is try and just bear in mind all that money you will get back. I ve always found the team at hsbc that you speak to are very friendly. Remember though that as you ve had to pay out court costs you will need to add that to the amount you are claiming.
    Good luck hope the music whilst your on hold dosen t send you to sleep. lol
