I have followed the instructions via the money saving website and have had no response from HSBC, even the letter threatening court action.

first letter sent 22nd June & 2nd letter 6th July.

I am thinking for sending one last letter, is there any point or should i start court proceedings? as i hear they have 8 weeks to respond.

I am not letting them win I want my money!!!

this site has been brilliant the information it has already given me has helped alot glad we are all giving it a go.

Did you send your letter via recorded delivery? I did to make sure they acknowledged it and would have to reply.

Got the usual b*llsh*t letter saying they looking into it, i said 14 days for money back...no luck so now in court proceedings.

They have now acknowledged my Claim, so got to wait 28 days to see what they are gonna do....anyone done the court stages with HSBC??? 1.5k would be great back and if i get the interest too that will be a bonus :rotfl:
• sent both letters recorded delivery, got a response to the first saying they were looking into my letter and thats it.

did you start court proceedings after your second letter? as i was thinking of sending another one.

really not sure what to do!!!!!!

hopefully they will come back to you in 28 days with an offer you cannot refuse.

Good evening all,

I have been thinking about this a lot.

I originally got into trouble with HSBC, racking up overdraft and credit card charges, when I was a lot younger.

They only way I could deal with the debt was to accept their Managed Loan offer. The original loan amount was £2700, and by the time I have finished paying it off in 5 years I will have paid nearly £4000. The other option would have been debt collection.

Since the loan was nearly as much as the total charges they had taken from my account over the years, could it be argued that;

1. The vast majority of the total loan amount was actually charges they had given me. Without which, I would have been able to personally manage the debt.
2. They have profited from the original charges, by selling me a Managed Loan, which is 9.9% above base rate and significantly higher than a standard product.
3. As I am (hopefully) about to win my claim of charges against them, they have profited from a crime against me, which they have been found guilty of.

If so, do you think I could somehow make a claim for this, once my original claim for charges refund is settled

i am in the same position so do let me know if you find out if we can claim on this. I pay 150 a month but 85 quid of that goes on charges!!

I faxed my acceptance letter to D and G yesterday morning, and £1850 was credited to my account yesterday evening.

I was due in court on the 2/8.

It has taken six months to sort this out.

Thank you to Martin and everyone on here.

Hi ya

HSBC wont respond until eight weeks is up, then you will get an offer of normally around 85% of your claim without interest. If you stick to your own timetable then you can now proceed with court action but prepared to wait longer than the eight weeks as the courts are so busy with all the claims that you could be looking at months. It really is down to the individual to decide, if you have a read back through this thread to about 10weeks ago you will see we were all asking the question "should we wait 8wks" i think the majority of us did wait and have had our monies now.

The choice is really yours, but whatever you do , "you will get your money back":T

Good luck and any advise needed im sure any of us will be willing to try and help.

Hopefully i should hear something this week!!!! as my claim was defended on the 03.04.07, recieved a letter from D&G on the 08.06.07 (sent to the wrong address) to which i relied on the 18.06.07. so from D&G's letter is has been 8 weeks on Friday. I am claiming about £4.5K reduced figure.

So hopefully i'll hear something or i am off to court. Anybody got any suggestions or views?
