    Lynsey is correct in my view. When you get your bill dated 22nd July send it off quick...as the ''send month 6 claim between 21st jun 2008 and 31st July 2008'' is worrying!!

    However, because of the different things E2Save have written on various bits of correspondence - I have written detailing the discrepancies asking them which of them is correct. I will let you know what they say - if anything.... I've got at least 5 months to get something in writing from them. :)

    thankyou, ok that would be great for you to do that, i guess i better get something off in writing to them aswell!! i thought i had it all wrapped up:confused: how wrong can you be. but thanks for your help

  • Very if you simply read the (totally) conflicting information they provide and stick a pin in which one to follow! Fortunately, they still haven't learnt that the courts wouldn't be impressed if people have to sue.

    I just rang the cashback team up on 01270 504440 to see if I ported my number over to O2 whether it would affect my cashback claim. (They said it didn't). While I was on I asked about my cashback explaining there were different conditions in their info. He said I should send in the bill with the nearest date on it to the date 6 months after my contract started. i.e. the bill dated nearest to the 21st July. I told him that my summary online said I had to claim from the 21st June. He was surprised by this and said it was definitely the 21st July... so as my bill was the 22nd July it would be that one. I kicked myself afterwards for not using my phone feature of being able to record the call!!

    I've got a similar problem. I sent my 4th bill in December as required within 30 days but (stupidly) I sent it to the Dunstable address provided in my original order confirmation email from E2save which says to follow this link for cashback instructions:

    I emailed them last week enquiring the status of my cashback to be told:

    "Your claim was sent to the Dunstable address not the Crewe address as stated in our terms and conditions and the email which was sent to you when you ordered the phone. All price match claims have to be sent to the Crewe address. Because of this your claim has been rejected.

    Regretably the terms of the Price Match claim system has not been followed and as stated in the terms and conditions it means that all future claims are forfeit."

    The printed terms and conditions that came with the phone and an email they sent 1 hour after the order confirmation email both state the Crewe address so I admit they did provide me with the information, BUT I feel nontheless cheated as by following the instructions (in good faith) in their original order confirmation email (which I printed out and filed at the time) they are now rejecting this and all future claims. At best I think this is incompetence on their part by providing confusing and contradictive terms and at worst it could be interpreted as intentionally misleading.

    I am really !!!!ed off as I sent the correct bill within the required timeframe, they confirmed they received the claim but due to using the "wrong" address my claim was rejected. I phoned them this morning and the girl said the decision is final and the only thing I can do is write a complaint letter. I am considering doing that and possibly filing a money claim online for costs of £420. Any one else had similar experience?

    Lots. But its a game which you have lost.

    You have to stick to the rules. They try to bend them, though you have admitted that wasn't the case as far as you have been treated.

    Don't know what grounds you have for a MCOL.

    A letter of appeal to their better nature, pointing out the confusion their e-mail caused looks your best chance.

    I think I have a strong case as their written terms state:

    "All claim information is supplied to you at the point of purchase".

    This is correct and as such they should honour a claim sent to a "wrong" address because they supplied me with this address at the point of purchase (by email). The sensible thing to do, which I am confident a judge would agree with, would be to honour the claim to the "wrong" address, point out the correct address and allow me to continue claiming provided I use the correct address in future. By denying me the possibility of claiming future cashbacks they are being unreasonable IMO (and hopefully the judges too!).

    I will write a polite letter persuading them to be sensible and if that fails I will definitely go to court and claim all cashbacks owed. At this point its an odds game, I dont really care if I lose the £35 going to court will cost me if I have a pretty good chance of getting back my £420 + court costs.

  • Vikktor:- the point of sale was when you completed the transaction on0-line before the email was sent to you. On there (had you checked, found, read and copied as you ALWAYS should at the time) there were claim forms download with the Crewe address and NO mention anywhere of the old one (which is, in fact, still being used for older-style contracts like some of mine). I'm afraid you really need to follow ALL the groundrules with ANY dealer nowadays or you are almost guaranteed to end up in a VERY difficult position. Whilst I'm sure a court wouldn;t be impressed with their deliberately misleading information and I have attacked them for months on all sorts, the main thing is this; read, copy and understand the t&c fully at the point of sale because most of the stuff afterwards will contradict them. It's the ones which you signed up to which protect you, not the email etc. you relied on - all information which (it has been plain for months) is completely misleading. AND for those repeatedly coming out with relief at dates appearing on the on-line accounts for their contracts there - AGAIN they are OFTEN totally wrong. You have all been warned - yet again!!

    I really DO recommend people take careful note of my groundrules - the earlier in the process of taking on a deal (THAT means BEFORE) the safer and wiser:-

    Ignore them at your peril. Most of the current problems people are now having would have been avoided had they followed them. I always do - and would take out more deals for myself and others who know that I do and will ensure they get their money. Otherwise, STEER CLEAR!
