E2Save Cashback Scam/trick

On the 8th August 2007, I took out a new contract with E2Save. It was a 12 month cashback scheme. The Carphone Warehouse are the main company and I've successfully claimed from them before.

When I took the contract I downloaded the cash back offers calendar and the cashback claim vouchers as recommended by the site. My first claim according to the cashback calendar was month six with further claims months eight, ten and twelve.

Month six has finally arrived. I telephoned E2Save to make sure their month six was the same as mine.(I didn't want to send the wrong bill!) I was informed by the cashback operator that I cannot now claim. When I enquired why, I was informed that I hadn't claimed month four.

I explained that the cashback calendar shows month six. I was then informed that the terms and conditions in font 4/5 that came with the phone states months four, six, eight, ten and twelve, therefore by missing the first one I'm no longer allowed to claim any.

This is an outrageous trick. Am I the only one stupid enough to fall for it. If not has anyone managed to get their money?

    There is another thread on here somewhere called 'E2save problem thread' with lots of useful suggestions - especially from Mobile Junkie.

    You might have scope to try and argue it under the Unfair Terms in Consumer Contracts Regulations, but you'd have to be preparted to go to court!

  • I'm in the same boat so I have passed my details onto a local BBC radio consumer programme. They have contacted E2Save's press office and they are looking into it. I'll let everyone know the outcome.
  • I'm afraid that although the information they give out is deliberately misleading I don't have total sympathy. All those taking out these contracts without even bothering to read (that alone print out and understand) the t&c they signed up to haven't followed ANY of the basic rules for cashback. Whilst I attack cpw a lot nowadays and don't condone the misinformation I'm afraid I also rather despair of people who go into these deals believing that the company will give them more than they receive with no strings attached. Just the most simple research and care would prevent ANYONE from making such a basic mistake. For starters, they must have ordered the phone whilst ignoring the t&c. These deals first appeared in late May/early June and despite the "normal" t&c on the site at several stages throughout the purchasing process there have always been warnings that THESE deals had DIFFERENT t&c to the normal ones. There was the chance to download them, print them out etc - and ever since they FIRST appeared there's been lots of comment on here about them. In fact, I know that you could go back well before September and find reference to the 4/5/8/10/12 months and a lot more. The t&c for these deals AND the claim forms were different from day one, labelled as such and available for those reading the information given. In fact, the main "trick" they employ is enetirely different; they don't actually follow the proper t&c - though not to the extent presumed on this thread. They ALSO are sometimes guilty of sending out the WRONG information WITH the phone; I had one recently telling me to send my thrid, fifth etc bills. I knew immediately this was incorrect and in any case ALWAYS copy the t&c I sign up to at the point of purchase. I will therefore ignore the written blurb swith the phone and follow the proper t&c.

    Cashback deals are usually NOT straighforward and anyone entering into one MUST realise that. If this sounds unreasonable I am just as scathing at those who appear on here and attack anyone for taking out a cashback deals because it's so obvious they won't get their cashbacks. I have also been scathing about cpw - but fair's fair! People have to take SOME responsibility when entering into a binding contract where they RELY on getting something for LESS than nothing.
  • I took a phone out with this lot in July, 12 month contract £35 a month, with 11 months free by redemption.

    They sent me a leaflet with the phone telling me to send a copy of the 6th bill for the 1st cashback payment. I did this last month.

    Now they've written to me saying they won't pay as I submitted it too late.

    Just phoned them up, and they say they also sent me an email in July saying claim after 4 months and ignore the leaflet. I told them I'd never received the email. They couldn't give a toss, very unhelpful attitude. (I've had a trawl and have actually found the email, but they don't know that.)

    Have I got any comeback here?
  • There isn't really a comeback as mobilejunkie has stated in his previous post. As for e2save customer service, they are as useful as a chocolate teapot and as helpful as paper at fighting fire, but with the amount of complaints they get day after day I can sympathise with the attitude (not condone it, but at least be somewhat nice to them up until about phone call 3)

    Lol. I do wonder if they've quietly removed the so-called "price-match" t&c because they've FINALLY realised they can't ignore them if they have them and that I was right when I argued with them about 6 months ago about the fact they won't have a leg to stand on. Should have listened... not something they're good at though.

    I must admit I'm not sure whether anyone MIGHT win a case based on the fact they followed what was misleading information; probably depends on the judge. Odds may be against you; don't make that kind of mistake in the first place.

    arrrgh, i've just picked a 11th month redemption with e2save with these terms.... i've just gone onto the chequeback pdf link and this is what i have, and dont mention anything about month 4!! even the bit about how to claim, still mentions month 6 rather than 4th month.

    would appreciate some advice, i've had cashbacks from e2save, mobiles2yourdoor, and carphone warehouse, and all have been ok.

    I keep telling people; the t&c have quietly changed. IT IS now month 6 for new contracts etc. If you can't work out the (very) basics, don't do the deals!
