As 29 days have passed from the date of the original Parking Charge Notice detailed above, Carparkers, as the creditor, now has the right to recover any unpaid part of the Parking Charge from you, the registered keeper'.
But it hasn't been 29 days...
From the date of the original Parking charge notice (13th Feb 24), to when this was issued (only received today but was issued a week ago on 4.4.24), is 51 days?
And from when I appealed (26.2.24) to date of thus recent notice (4.4.24) is 38 days.
By responding after 51 days, they have satisfied the 'after 28 days' condition.
I thought they had 35 days from my appeal to respond to me, and if they don't the case gets dropped? Is that not right?
Responding to an appeal has one time limit, but it is nothing to do with whether the keeper can be held liable or not.1 -
Are you are saying that you have not had a response to your Plan B appeal but they have sent you a reminder letter?0

Through the advice of this forum, I appealed it through the website that was on the parking charge letter.
Then I got the reminder letter through the post today.
But I see what you're saying....would they have responded to my appeal in any other way other than a letter through the post?

Email them with a complaint (not an appeal) that you have not had a response to your appeal but have received a reminder letter. Where is your appeal response and POPLA code? Complain about them to the BPA.1

So am I wrong in saying that, because 35 days has passed, they can't charge me the £100?
Online, it says 'The parking operator has up to 35 working days to issue a response to your appeal, as per the British Parking Association's (BPA) Code of Practice' which in this case, its been 38 days since I submitted my appeal to them.0 -
No complaints contact details?
That's odd, given that the BPA AOS list shows all members' complaint policy/contact links. So am I wrong in saying that, because 35 days has passed, they can't charge me the £100?You are wrong to think that. Forget it.

30 seconds with Aunty Google found this:How to make a complaint
Customers who wish to make a complaint must do so in writing. This is to ensure we know exactly what the nature of the complaint is and this reduces the possibility of ambiguity or the customers complaint not being recorded over the phone. The complaaint will then be registered onto our system and a unique reference code generated.
Once the complaint has been received, we will acknowledge the complaint within 14 days and provide the unique reference code. The acknowledgement will be sent to the name and address or email provided. In the absence of valid contact details, it may not be possible to proccess a complaint or proccess it within the published timeframes.
you will receive a response within 28 days, if we are not able to resolve or respond to your complaint within 28 days, you will be updated on the progress of your complaint and the current timeframe for completion.
A Complaint must be made in writing via email or post

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It is simple (and as you'd expect): you have to complain to the PPC before you can escalate it to the BPA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
