  • Just an update VCS have now dropped ELMS legal and are representing themselves now that this is a ‘defended case’ just as @Coupon-mad said they would at the start of this thread.
    Did VCS drop ELMS or did Elms pass the case back to VCS as it was a dud case ?

  • Just a question: I sent my N180 form on 7th September exactly as described in the newbies thread (sent on working day and copied myself snd VCS into the email) Got an email to myself and the CCBC confirmation email so know it sent. Heard nothing from them nor has the MCOL site been updated. Is this standard? Just the MCOL site updated really quickly when I sent my defence.
  • I’m sure it’s all fine just where it says ‘if you do nothing judgement may be made against you’ has me on edge that if some of my submitted files get lost I’ll take the blame and get a CCJ.

    It takes months to get allocated to your local court. As long as you got the auto/reply, all is good.

    But right now, we currently need people like you to do one email to the DLUHC to change the law:

    Make sure you attach copies of the aggressive £170 demand letters and the Claim form (redact your address and claim number/password) to provide evidence of what the parking industry and their 'debt -chasers' and Elms Legal attacked you with.

    Obviously state at the start of your email response to the DLUHC that you are a consumer and are answering Question 4.

    The added £70 on top of an already very high penalty - plus 8% interest - has inflated the claim ridiculously and makes you less likely to deal with aggressive parking debt crawlers.

    Add that you want your case to help the DLUHC to have sufficient evidence and case studies to ban the so-called 'damages' or 'contractual fees'.

  • Right question 4 DLUHC fully answered with attachments of all threatening letters sent. I hope this helps get things changed. Last minute but everything I do is last minute!
  • Just an update on this case. I now have a hearing date later in the summer and must submit my witness statement by the end of March. I’m going to use the newbies thread checklist (Coupon-Mad dated 2014 with links to Bargpole?) as a guide for my witness statement and accompanying evidence. 
    Assuming my witness statement and evidence is complete and arguments rehearsed I should not need anything else on the day of the hearing?
    Any other advice from anyone appreciated.

    bargepole's guide to court is still up to date as far as I know. Read and re-read it, plus the twelve step guide in the defence template sticky to make sure you haven't missed anything. 
    Usually a WS is required two weeks before the hearing date, so check your dates because a March submission date for a hearing in summer would appear to be very early, although it is entirely possible.

    Post your redacted draft WS here for a sanity check before you submit it to the court and the claimant. When sending anything by email, send it to yourself as well. That way, if the court got it and you got it, on the balance of probabilities, the claimant got it as well. For some inexplicable reason, some PPCs seem to have a recurring problem of not receiving documentation.
    Post the claimant's WS when you get it. Watch out for it arriving late, but make sure you do not miss the court mandated deadline.

    You will need to submit a draft order for costs a few days before the hearing. You could visit the court beforehand to familiarise yourself with the location and process, speak to the ushers, and sit in on a parking case or two if you can, and take notes. You are allowed in because it is a public place.

    On the day itself, take a crib sheet with you listing your salient points and your defence/WS paragraph/exhibit numbers so you can quickly point them out to the judge. Also take a spare copy of everything in case the claimant says they never received it, or the court has lost it. It does happen.
    The claimant will go first, so take notes, then it will be your term. Wherever possible, challenge/correct anything in the claim, their WS, and what their advocate say. If you win, don't forget to ask for your costs. Include mileage and parking if your drive, I love the idea of including cost of parking in a parking case so remember to include an estimate in your costs schedule, plus food and drink, plus lost earnings or lost holiday entitlement etcetera.

    On the day, arrive early, speak to the ushers to find out where the hearing will be held, and write down the name of the judge, who you should refer to as "Judge".
