PLEASE REPLY TO QUESTION 4 OF THE GOVERNMENT'S 'CALL FOR EVIDENCE' RE THE LEVEL OF PARKING CHARGES

This thread is to encourage anyone dealing with (or who previously dealt with) £160 or £170 demands from a private parking debt collector, such as:

Debt Recovery Plus
ZZPS
QDR
Elms Legal

Trace Debt Recovery

DCB Ltd or DCB Legal

to please respond and attach copies of your letters in answer to QUESTION 4 near the end of the Department for Levelling Up's current 'call for evidence' which is considering:

THE LEVEL OF PRIVATE PARKING CHARGES AND THE ADDED DEBT RECOVERY FEES.

Your evidence can help change the law.

I won't repeat Q4 here as it is long.

Doesn't matter if this was last year or earlier.  Or are you going through this now?

This is about what effect the threatograms had on you, e.g. :

-  how the Debt Recovery firm treated you?

-  and whether the fact that the sum demanded was now £160 or £170 (per PCN) was a main factor that stopped you paying?

Please answer honestly - in particular they want evidence, not just opinion - so if you still have some, do attach the £160 / £170 threatograms that you got, as your evidence, and it is very important to recount any conversation you tried to have to resolve the matter with the debt collectors or solicitors. 

Tell the DLUHC in question 4 whether:

(a).  the PCN(s) was so unfair that you wanted to resolve it in court and would never have paid a debt collector, or

(b).  you wanted to resolve it and would have paid a more reasonable sum if you'd heard about it sooner, or if the debt collector had listened to your dispute and reduced the sum demanded, or

(c).  you paid? Why, what caused you to?

(d). something else?

It's consumer behaviour when faced with a PCN or higher demand that Q4 is specifically asking about.

And the DLUHC do want to hear from you.  The Call For Evidence says:

"Responses are invited and welcomed from all who wish to respond. Respondents are strongly encouraged to familiarise themselves with the draft Impact Assessment before responding.

As the final impact assessment will be compiled following this call for evidence, it is important that anyone who feels important evidence is missing from the current draft document, that assumptions are incorrect, and/or that they are able to provide further insights into issues covered, provides that evidence now so that it can inform the consultation on parking charges and debt recovery fees."

The Call for Evidence closes the first week in October so please do this sooner rather than later.

You will see I am collecting photos of car parks & signs in the UK where there is:

"NO OR LOW DETERRENT"

i.e. PCN up to £70

or

No PPC infesting the site but it isn't abused

or

the signs are so faded, broken, or altered by stickers that any deterrent value is false.

Just to add, for the more robust among you who are also good at sounding measured on the phone, even when talking to a scammer:

If you have a threatogram in a case that is still 'live' (but not yet at court) please phone up the DRA or the 'Legal' firm bothering you, and record them and submit that voice file recording to DLUHC.  One email, answering the 'human behaviour/response' DLUHC question 4 from the heart in your own words, attaching your letters and phone recording as evidence.

Not enough people have done this but the evidence would be golden to prove that reasonable people are just being bullied.

I hope some robust newbies (at PRE-ACTION stage) have recorded the bullying phone calls of DRAs and legal firms, or plan to do so within the next 2 weeks.  That will be key evidence if you could individually send your recordings to the DLUHC.

One more piece of evidence please.

I want to show the DLUHC proof that when a PPC passes a case to a DRA or bulk litigator, the PPC does no further work on it and washes their hands of it.

I can recall loads of threads where consumers have been told it's "too late to appeal" and "the case is now with debt recovery so you must contact them".

This is probably more something for the regulars who are ace at searching the forum,  but can any of you help find such comments on threads please?

Would this recent one count? PE employed DCB L and said since a LBC had been issued it was out of their hands, then the landowner cancelled it.

As I said in that thread, ParkingEye is spouting a load of old rubbish. Just because a LOC has been issued matters not, the charge will always belong to PE and to wash their hands of this, just shows they have been brainwashed by a scam industry

ParkingEye has got themselves into a Kray Twins type operation and if they really think that DCBL is their answer then watch this space ?

ALL PE signs are just as bad as UKPC and DCBL alone have made UKPC look like idiots .... assume ParkingEye want to be made to look like idiots

@Coupon-mad there are some "too late to appeal" and "the case is now with debt recovery so you must contact them" kinda comments on the parking industry's Trustpilot/google review sites would you be interested in links posted to these individual reviews or is it only MSE ones ?
