is it too late to appeal (after debt collector letters) and whom to appeal to?
I’ve read a lot of info on this website, but i find it overwhelming, and i cant take it all in, due to illnesses and conditions, (mental, physical, neurological and developmental). Car park is managed by Euro car parks. PCN (parking charge notice)/NTK sent to RK from Euro Car Parks via post, claiming ANPR camera caught RK’s vehicle "parked without a valid Pay by phone transaction".
It is free to be parked in the car park for up to two hours, but parking more than 2 hours requires payment, and payment is by phone only. Images of number plate on NTK, captured by ANPR cameras, claim entrance into car park and exit from car park to be just over 2 hours, by just a few minutes.
RK researched on line regarding appealing, took photos, wrote a document on their computer, etc, this took a very long time (the majority of the time, RK does not have the mental capacity to write, due to disabilities a nd illnessess, mental, physical, neurological and developmental), so can only write when they have the capacity to do so), RK tried to appeal by internet, filling in info boxes, attaching photos, and copying and pasting a statement/ document into website box/page, and clicked on send, message came up stating “no further appeal can be made against this parking charge notice (PCN), the PCN has been forwarded to debt recovery plus ltd. all/any communication must now be directly with debt recovery plus ltd whos contact details are on www.debtrecoveryplus.co.uk or telephone 0…. .” This only appeared at the end. RK took photo of this, RK also got confused regarding timescale.
RK has now received letters from debt collection company, whom have increase the charge, and keeps getting these letters.
Correct me if I am wrong, you state
1.) do not contact the debt collection company, but I am uncertain why.
2.) appealing to POPLAR can only be made if you appeal to the parking company first, WITHIN their given time frame. So its too late for POPLA to be involved I guess.
So, RK doesnt contact debt collection company. Correct me if I am wrong, RK cannot appeal to POPLAR so can anything be done now regarding appealing, whom to appeal to? Given that when RK tried to appeal to Euro car parks, an automated message stated that RK cannot appeal to them? Do RK still appeal to them? Whom else to appeal to? Or write a letter of complaint to? NTK states that Euro car parks are a member of BPA, is it worth writing to them? Or is that a waste of time? Any other organisations/geverning bodies to appeal/complain to?
RK doesnt know whom owns the land, the car park is just off a high street, the car park is not part of a supermarket land, its a small ‘open air’ car park, and RK has recently moved to the area.
Also when a driver or RK has illnessess and conditions that effect their ability to write an appeal, surely they should be given more time to write an appeal? surely to not give extra time is discrimination and is breaching legislation, including but not limited to, the equality act?
A friend has read the appeal document that was saved on computer, their comment was that its “very combative toned” nad they think by “phrasing it in a more kindly way” would “get further”,Comments on this would be appreciated. RK was trying to adopt a similar tone to the one in your template letter.
At this stage, I wont go into details of what is written in appeal document (unless asked to), but the time frame from the date the document was created, to the date is was last modified is one month, and this is after spending a long time time reading and researching online, and this is using a template letter, and also it was altered slightly after copying and pasting onto Euro car parks website. I am trying to explain difficulties with reading, writing, grammar, working memory, short term memory, etc.
this is causing anxiety n stress, so RK dosnt know whether to just pay the amount that the debt collection company is asking, or whether to stand their ground. RK lacks the ability to make decisions. Also RK has problems with post and emails, opening, reding, responding, etc. Also RK has other problems/complaints to deal with.
Also, There are no disabled bays in car park, and signage states that there is “No concessions for disabled badge holders”. Surley this is discrimination, and is in breach of the equality act?
