Does this not meet black mail? Another £220 we know we can’t claim if you don’t pay up…

Surely thats like me saying ‘without prejudice I offer to pay you £10. If you don’t accept this offer I’ll smash your face in I know where you live’ But thats fine cause you can’t mention that in court.

You got it.  You cannot and must not share letters with offers (except at the end re costs).

  • I hear what you’re saying but with reference to the bit of text I posted above surely this acts as blackmail/coercion? You always burst my bubble @Coupon-mad ☹️ Seems like an absolute **** take a rule like that which they clearly exploit.

Do NOT use words like blackmail or fraud in court.  Beware.  Slow down and deal with the contractual allegation (the claim) only.

Without Prejudice certainly means you cannot show the letter but a judge can decide
You blanked the top of the letter, does that show Without Prejuice ?

I struggle to understand why they would show it in court and expose themselves. Just because you will not comply with their request and pay is what the court case is all about

Legals have tried to add such costs before and been denied as the £50 legal costs is the rule in a County Court.

Such threats could be deemed as unreasonable behaviour
And as Coupon says do not use such words in court, let the Judge decide

The text you are looking for is at the end of the longest paragraph...

The "offer" is made without prejudice. However, the "threat" is not covered by it. They even say that they will produce the letter in court on the subject of costs. The defendant, therefore, is equally able to show the letter and the "threat" as evidence of unreasonable behaviour, whether they win or lose.

I know its a grey area. Mind you I’m not a legal professional and I know nothing about court so how am I meant to know what documents can and cannot go as part of my WS.

That's why you're here - getting advice to help you to understand the various intricacies.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
