    Its been just over 3 yrs and 6months for us in UK. Will these proceedings affect our PR process which is due in a couple of years? Me and my wife work with the NHS and the car is in her name but i was the driver. Will it affect our jobs? so every time a letter comes we get stressed out. These proceedings are something new for us; Im just following your advice at every stage hoping to get this resolved as mentioned in your posts. My wife is so stressed (also she's a mental health nurse, NHS) and it adds to her stress at work; she just wanted to pay off the fine and get rid of this unnecessary headache but i requested her to pursue this your way. Hope this has a happy ending; didnt want to get involved with the court stuff; is it possible? Also wanted to check if this is a court claim/ CCJ

    This is a civil dispute between the parking company and the defendant , over money 

    Its not a fine, its an invoice for the alleged breach of the parking contract on that private property 

    There is no reason for it to affect anything except her bank balance if she lost in court, by the amount shown on the court claim form, £284.28 , or more likely to be about £212 after spurious debt collectors fees are removed 

    This is a court claim, if she lost it in court she would be told to pay the judgment within 30 days, the grace period allowed for full payment, to settle the matter once and for all. It is not a CCJ 

    She is the person who must deal with it by following the advice on here, if she is the defendant 

    This legal matter is nothing to do with you personally, regardless of being the driver, but you can and should be her guide and helper, using the advice of the people here, especially following the details posted by coupon mad and KeithP, plus the other helpers on here

    The chances are that the Claimant will discontinue before the hearing, in which case its game over, job done 

    No need for anyone to get stressed about it

  • Since this is a court claim, i suppose we need to go to the court and in that case do we need to hire a solicitor to fight our case? Solicitors are very expensive to hire as i have heard about them. Im not aware of the court practices here in UK. Please advise.

    No.  Nobody needs a solicitor and you would not get your money back.

    There are a lot of hurdles to jump before any actual court hearing, even when these claims are issued many don't even reach a courtroom or judge. At the moment there is no court, just a claim from a government department in Northampton 

    Both sides have work to do, the claimant has at least 2 fees to pay too, before any judge gets to hear it 

    Concentrate on what is in front of you both, the future is very uncertain, pointless speculating about it

    Yes, but only if having a Judgment against you and you also fail to pay the judgment amount within the timescale allowed.
    In other words, if you lose the case and pay the amount awarded reasonably quickly then there will be no lasting Judgment and hence no stain on your creditworthiness.

    I don't know why you have shown us all that other stuff though.     ;)

    And now you see how these vermin operate. They hope that low-hanging fruit on the gullible tree will capitulate out of ignorance, especially once they initiate litigation. Many people will have the same train of thought as the OP does. Fear of litigation based on ignorance of what is actually involved and too much "reality" TV following 'bailiffs'.

    As already pointed out, as long as CCJ is paid in full with 28 days of judgment, there is no record of it on your credit file. It is completely expunged as though it never existed.

    Also, the thought that you need an expensive solicitor to represent you in a small claims track hearing in the county court is another misconception that far too many people have. This is not a criminal matter and it is not the Old Bailey with wigs and robes etc. Have a look at this show video of what is involved in a "hearing":
