    I was duped by EM last August and am sure that I only had a 12 year contract, but their paperwork is showing 18 months !!!! anyway, I sent in my bills at the begining of Feb this year and have received nothing back....and after reading the previous emails I don't think I'll hold my breath.
    I always thought myself as carefull in these matters, but there you go...

    It will be interesting to see if anyone is successful in going through the small claims courts...

  • Thanks for the advice - ever felt that youve been a mug. I think from now on I'll go by the golden rule - If its to good to be true then it isn't. Part of me says is it worth the hassle fighting on. If they can't pay then there will never be any money for the wee people to get back.
  • Hi all,

    I have been in contact with Ofcom who are very aware of EM's practices and advised me to contact Trading Standards. I was told to write a letter to both EM and the mobile service provider, in my case O2 giving them both 10 days to reply. The advisor at Ofcom did mention that there are new legislations in place to deal with 3rd party companies like EM and went onto say that O2 may even agree to cancel the contract. I have also emailed Watchdog so let's see what happens. Will advise on any further actions.

    Hi all, i've today had an e-mail back from the Advertising Standards Authority. I complained to them as I knew they had made a judgement against Express Mobiles in respect of complaints from people who received text messages back in August advertising this scam. They seem pretty weak in what they can do, stating that they have tried to contact Express Mobiles to seek reassurance from them that they will comply with the judgement, but EM have to date failed to respond to their requests !!! ASA do not believe this company to be legitimate, but they don't seem to be able to do anything about it. A toothless lion !! They have referred me to the Information Commissioners Office www.ico.gov.uk. So, i'll write to them now and see if they can do anything.

    Meanwhile, I have contacted Orange and was given the same story as the correspondent called Wavefinder. They do not see it as their problem. I have now written to Orange Complaints Dept. in Bristol as I believe they have a responsibility to their customers. At the end of the day, Orange will be paying Express Mobiles to sell their contracts for them.

    I will also be writing to Hampshire Trading Standards.

    If anyone is interested, I did manage to get one cheque for £120 out of Express Mobiles. The cheque shows the company as "TELCO LTD" T/A Express Mobiles. Their bank is Lloyds TSB Romsey branch.

    I'll also contact BBC WATCHDOG and I would urge everyone to do the same, as the more people that contact them, the more likely they'll realise they're a scam and should hopefully run a story on it.

    I have now been waiting since last year august for my cash back form this company. After repeated phones calls which were answered, and emails, all of which were opened, but never replied to. I have still not received any payment. I have again tried to call the 0800-198 1001 number which now has a recorded message referring to the web site. I am now at a lost of what to do, file a complaint to ofcom, speak to service provider orange, or try and obtain the monies via the small claims court. I look like there are many of us in the same position judging by the amount of information on the web. Any ideas on how to proceed as one voice.
  • I am also in the same boat, I am going to contact Orange to see if they will first of all cancel the deal or second drop the tariff.

    Failing that I will contact Watchdog tomorrow in the hope they will be shamed onto National TV and as a result the providers will have to cancel contracts out of good faith.

    I notice now that the you can no longer call them, one can only imagine due to the sheer number of complaints! I have received one cheque pre-xmas but they have had my second batch of installments since early feb and I haven't heard a peep!

    Aside from what I am suggesting does anyone have any suggestions, I feel legal advice will not be appropriate and a waste of more cash!

    of course, its quite possible that the scammers at exp mob probably read this thread and are having a big laugh at us all! well i have an update, if its worth anything. partner who is in same position as you all, actually had a reply to the email thay sent asking about the delay in cashback, just asked if the cashback forms were sent by mail! obviously using delaying tactics again!

    I have today received an e-mail from Express Mobiles. It reads as follows.....

    Thank-you for your e-mail.
    Your claim is pending, however due to our current financial circumstances there will be a delay in payment, this will be reviewed on Tuesday 8th April and we will contact you accordingly.
    Kind Regards
    Express Mobiles.

    Hmmmm, this is the first time they have admitted to me that they are in financial difficulties. All the other excuses have been the usual "waiting for the bank to send more cheque books" or "remind us how and when you sent in your phone bills" !!!

    It's probably another delaying tactic which will give them 4 days to shut up shop and jump ship.

    But, we'll see what 8th April brings. Guess it could have been 1st April though !

    Meanwhile, i've made a formal complaint to Orange, and BBC Watchdog. I would urge everyone else to do the same.

    Lets keep fighting.
