The best advice on this forum is the simplest of them all. No threats, no victim syndrome, just pure advice like that from Alexlds - I salute you Alexlds!!

    The company to sue or claim from is TELCO Ltd T/A EXPRESS MOBILES. Just use the small claims online. Telco Ltd have operated as Express Mobiles as evidenced by cheques which they sent to customers late 2007 and early 2008. They will send you letters claiming they can strongly defend your claims, indeed they will defend. Once the court calls them for hearing they won't turn up, resulting in judgement by default. As long as you have claimed from TELCO Ltd, they will eventually pay. You still can get you money, especially if they have ever paid you something before - use that as evidence.

    ALL THE BEST! Don't follow any threats or seemingly wiser suggestions!

    I have advised and followed this thread for a number of months and have only issued instructions that are not speculative.

    Here is the present situation:

    Express Mobiles are allowing judgements to be issued against themselves. This was not happening before. There is a simple reason. THEY ARE NOT GOING TO PAY UP. There are a number of judgements outstanding. Unless someone is prepared to send in bailiffs to collect the money (which I believe one has tried to do unsuccessfully) then it is best not to go to the expense of recovery.
    I have had a successfull court claim against them but chose not to pursue further action on future claims once it became aware that Express were no longer concerned about having the court orders issued.
    I am not sure if Express Mobiles are still in business.

    All are therefore punished

  • I instructed the courts to send in the Bailiffs just before Christmas and had a reply from them 2 days ago. Waste of time and money, the company do not trade from The Tanneries any longer and they have nothing that can be ceased as they owe me in total £715. If anyone does have any luck in finding them it would be interesting...Good luck.

    They are in breach of contract if they dont pay you as specified in their T&C

    You can sue for the full contract amount less any payments already received.

    Their Defence will be that they are not connected with Express Mobiles. Luckily I had photocopies of their cheques issued by "Telco Limited t/a Express Mobiles".

    They wont turn up at court.
    Following the "SIMPLISTIC" but effective advice from this site works. It did for me. I got ALL my money. I quote again alexlds! Simple advice, simply the best! I have proof of ALL my payments. I am not here to mislead, but as a disgruntled customer want to help others get their money back.
  • I, like so many others it seems, was taken in by this "too good to be true" offer. I've had so many problems over the last... Almost 2 years now in having my money. They acutally claimed that I was in breach of THEIR T&C's and wouldn't pay me, so I sent a letter back saying that they were in breach of their own T&C's when they failed to get my first cheque to me within the 28 day period they set.

    I really want to follow the advice alexlds gave, but I'm worried it will get thrown back in my face as I don't have photocopies of the cheques that were (eventually) sent to me, I wasn't that clever. How important does anyone think this will be?

    Before you spend money on issuing any summonses, read through the recent posts from those that have won judgements in court but failed to enforce the judgements, despite paying out even more for bailiffs.

    JGirl Ask your Bank to give you copies of the cheques which were sent to you. Explain to them that you need them for legal reasons, they should be able to do that for you. Once you've got them just follow the advice above. Guud Luck!!!;)

    Hello all,

    I'm now at the position of comtemplating bailiff action against Telco Ltd. I've won my case against "Telco Ltd T/A Express Mobiles", but at the same time in my evidence pointed out that their default address is no longer the correct trading address for Telco Ltd. Of course the companies house registered address is the accountant's address (that's a dead end too).

    So this leaves me with the address at their website telco.uk.com

    Whiteley
    Hampshire
    PO15 7FJ

    I have also traced the addresses of the directors of Telco UK Ltd, which may also be addresses to send the bailiffs to (as directors are jointly and severally liable?).

    I have also emailed judgment of the court and order for payment to Sally Bowles, the directors and Gareth Birkett @telco.uk.com, and have received read receipts from some of them, confirming they are employees of Telco Ltd.

    I've even got picture evidence of Mr Birkett in a Telco Ltd footie top to demonstrate he's playing away!

    I'd like to ask advice from the people on this forum on which address I should send the bailiffs to, in order to maximise my chances of payback.

    Any advice / comment much appreciated.
