    If you have issued a claim against a wrong defendant, and you lose the claim at a hearing at which the wrong defendant attends, then not only do you lose your costs for the hearing on top of the claim, you will also have to pay all the defendants costs.

    Hi all, have'nt posted for a while, think I'm still in shock from receiving my third payment!!!
    Its that time again when I've submitted my fourth claim, the 28 days are up and , yes, I have heard nothing from express or is that Yesmobiles or is that Telco.
    Anyway have sent my letter giving them 10 days to respond, surprise, surprise they did'nt, so now I have to go down the small claims route once again.
    Just wondered who I should claim under this time.
    Is it
    Express mobiles at 5C The tanneries? since although I was paid when claiming against Telco, they did still try and defend it, they said it was Yesmobiles, but then when I have looked at other posts, perhaps it is better to just claim against Express Mobiles.
    Any help with this would be much appreciated.

    I googled for Express Mobiles to check on their useless website and see if anything was updated and found the following..
    http://www.yes-mobiles.co.uk/
    Hampshire Trading Standards, are as already mentioned involved and the address is listed at the bottom as P O Box 582 in Fareham.
    This is at last a proper amount of information and it is good to get solid confirmation on some questions like addresses and who is who trading as!

    Just more delaying tactics just as I said in post 121 (17th April) We have no chance of getting any money !!!!!:mad:.

    The last paragraph of the legal banter link above i think is the most interesting as a class action is growing.
    I have looked up yes-mobiles up on Whois domain search too.

    I get the impression the Indians are starting to circle Yes-Mobiles and Express. Personally, I have received two cheques and am now waiting on one.

    After seeing on this site the amount of other people that have been conned by this company, I have taken this matter further (legally speaking) and would like to hear from people whom can help me (and likewise) as I will be having a 'meeting' with the director of this company soon.

    They have used every tactic to squirm their way from paying out to genuine customers (and me!!!) this is out of order.

    Send me a private message if you can help, maybe come with as a 'witness' to my meeting or post here of your experience as I have been conned by these people and am not letting them away with it!

    Hi everyone, can you tell me how I can get my money back from Express Mobile. They own me £360. I was trying to cancel my contract with O2, but they not interested in my case. I'm student, only in summer I do part time job. I sent my bills on time, but I never received any money.
    The thing is that emails with my bill copys I deleted, so even if I take them to court I don't know what evidence I can show.
    And can somebody give me advice, how to take them to court??? please!!!!

    And if you have a meetings with the directors of that company, can you tell me how and where to find them??? Because if I know the address I would go to them....
