it looks like the whole express mobiles, yes mobiles, telco group is about to go under the 0800 number that express gave has now been disconnected . they are saying that they are going to defend all claims, this buys them more time, all claims in the pipeline will not be paid (including mine)

the info that i have is that the PO Box no that Express give is in a industrial unit off Newgate Lane Fareham (i live 15 miles away ) this has apparently now been vacated .
In the claim i put in i stated i was willing to attend the local court . By saying they are going to defend the cases this gives Express?Telco more time . Then even if we all win and there is no money in the company we all lose

Yes - filing just an acknowledgement gives them an extra 14 days (on top of the 14 they get at the time a court claim is issued).

Then on day 28 they can submit a defence (in the case of the cpw group, they send in a standard defence saying something like "we deny owing the claimant anything at all").

This buys them more time, as the case then gets transferred out of MCOL to the claimants local court, more correspondence has to be exchanged (and the claimant pay more fees) before a hearing is set. All this adds around 3 more months. Very frustrating if during this time the Defendant manages to disappear from the scene.

Has anybody actually managed to get a cheque from them recently without having to threaten further action?

    Ok Guys.

The claims issue here seems to be moving on to a new stage.

A lost of us have made successfull claims thus far.

Now Express seem to be fighting back saying they are contesting new claims.

Clearly a change of tact. But not one to be frightened by.

Can people who have their claims contested list the reason for contest on here as soon as they become aware of it.

Then we can advise and discuss the next steps.

    Regards
Just got mine sent back. They are going to defend claim, but the name is different (yes Mobiles).
Are people stilll trying the 08700 200 200 number?

I have today had a call from Hampshire Trading Standards who have this week had a meeting with Yes Mobiles and it seems that they are having financial difficulties and it looks as though we will not get our money. They are defending all small claims to give them more time. Express Mobiles are supposed to be writing to everybody explaining the current situation but as they only have one member of staff dealing with administration don't hold your breath. Apparently the actual trading Company is Yes Mobiles t/a Express Mobiles even though all my correspondence has come from Express Mobiles. I have taken legal advise and been told that Orange are legally bound by the representations of their Agents (in this case Express Mobiles)to ensure that their products are not missold. Express Mobiles clearly missold the products of Orange. What do we do next?
