  • I too have received a DCBL notice of discontinuance after a 2 year legal battle which saw me receive a default judgement which I had to pay £275 to overturn.

    i wrote to the court and filed a claim for my costs. The hearing is tomorrow 15th Jan 2024 and I need to prove unreasonable / improper conduct from DCBL. DCBL have responded to my claim arguing that if I’d only paid their bogus fine then none of this unpleasantness would have been necessary ie classic gaslighting. Amusingly, they are even disputing my claim for parking costs while attending court!

    I will be citing figures from this thread and describing their systematic abuse of legal process; any other tips or suggestions welcomed!

    Has anyone researched the possibility of requesting the Attorney General to seek a "vexatious litigant" order against DCB Legal under Section 42 of the Senior Courts Act 1981? 

    These orders are usually aimed at litigants in person, but the language seems broad enough to catch a law firm that issues claims on an industrial scale in order to harvest default judgments, but with no intention to proceed in cases that are defended, thus wasting the time of both courts and defendants and causing unnecessary anguish to defendants.  An aggravating factor is that the individual POCs are invariably in breach of the CPR and liable to be struck out as an abuse of the court's process.

    Thoughts?

    The practice of DCBL is a scandal and akin in many way ways to the Post Office scandal.  The Post Office scandal affected some 1000 people. Whilst this is a different scandal it has probably affected 10's of thousands of people who just pay up in fear of going to court not understanding that judges have woken up to the scam

    Government were fast asleep on the post office scandal and they are now running around like scared jack rabbits

    The Attorney General, if he is still awake, must sanction the likes of DCBL and the other legals who play the scam game

    Strike while the iron is hot ...... Media, TV, there is a story to be told and maybe the Attorney General can wake up

    Happily do my bit but we must have a plan of action

    This forum and Coupon-mad ARE a force to be reckoned with ... let's take it the next level

  • My story has already been in local and national press as well as radio. If I can get a result tomorrow, it feels like that might be some kind of precedent and would make for another story which might help the cause.

    Forgive me if I’m going against the consensus on this Forum, but I’m not comfortable with the comparison with the Post Office Scandal. People were imprisoned, families were destroyed, lives were lost. We all hate unfair parking tickets and predatory litigation - but there’s no comparison between a loss in a small claims case and what happened to the Post Office victims.

    I agree with you, but we don't actually know how many people have suffered stress, mental health problems and CCJ's damaging their credit.
    All because their car is a money magnet for scammers

    This is a different scandal and can only be exposed by mass media publication

The District Judge agreed with my contention of unreasonable behaviour on behalf of DCBL and contended that their ‘commercial’ decision to discontinue was actually because they knew they were going to lose. He awarded me £238 for travel and parking, attendance at court and filing of documents. Now I’m going to try to get that story into the press.

    As this is the 'discontinuances list' thread only, rather than us drag it off on a tangent, and because your case is important, please could you start anew thread stating how you got your costs, what you did, how late was the discontinuance (how close to the hearing), what your submissions looked like and which court/Judge awarded the costs?
