Spring Parking & DCBL LEGAL - I won in court!!!

On the 20th June 2022, a letter was received from DCBL regarding a PCN from Spring Parking in 2019. The driver was parked in a marked bay the company they work for leases from the landlord, yet failed to show the permit to park, hence the PCN. Unfortunately, the driver's contract with the company does not say he is entitled to a space, but was clearly working for the company and has their contract of employment. The landlord is a wally and refused to cancel the PCN despite the company asking to do so. A few other individuals within the organisation also received PCNs for the same reason. On the 20th June the driver sent a SAR to Spring Parking and also sent a Debt Denied to DCBL Legal.
Today (14th July) the driver received an email from DCBL to say the matter will be on hold until further notice and they are reviewing the matter further with the client (Spring Parking). The driver still has not heard back regarding the SAR request and it is nearly a calendar month, so it will be a complaint to the ICO next!
Is the driver right in thinking it is just time to wait to hear what happens next?
Thanks in Advance!

Yes. Sit tight.
All this harassment and adding a false 'DRA fee' layer that was never incurred is partly a way to gaslight and intimidate people into paying more, and partly it funds the 'race to court' roboclaim culture.
Both of which must end.
And that's what we want you to tell the Government. As we will (again...this will be the 3rd and final Public Consultation)!IMPORTANT - IF YOU WANT TO CHANGE THE LAW ON THIS:
Please read this and come back in good time for the upcoming Public Consultation (date TBA) that you will no doubt be keen to respond to:
https://forums.moneysavingexpert.com/discussion/6371803/time-limits-on-pcn-court-claims#latest
Read it if you didn't know the Govt very nearly got a statutory ban on DRA +£70 extortion over the line, and lower parking charge levels, but the moneymen have temporarily blocked it last month, and threw their toys out the pram.
We need high numbers of genuine victim respondents to unblock it again.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all!
Driver still hasn't had anything in regards to the SAR request to Spring Parking, they are going to send a complaint to the ICO. Should they send a chaser to Spring Parking too?
Thanks!0 -

Thanks!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

How is this:
Dear so & so
As you have failed to assist me with my SAR request, I am giving you the courtesy of 7 extra days or else I will be complaining to the ico as you have failed to provide me with any data that you hold on me.(Taken from ico site) The ICO may take action against a controller or processor if they fail to comply with data protection legislation. For example, they could issue a controller or processor with a:
- warning;
- reprimand;
- enforcement notice; or
- penalty notice.
Kind Regards2 -
Looks ok to me apart from the 'Kind regards'. At best this is a business letter, so Dear Sirs/Yours faithfully, but the reality is that they are trying to screw you over for £100! Why not 'Love and kisses'! 😳Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Haha it was realised after putting it in the draft format on email. Trying to juggle this email and a work one!
Don't worry, definitely has yours faithfully!1 -
SPRING PARKING ? Not a normal parking cowboy seen here ?
Of late, we have seen names we don't normally see. My guess this that both ATA's are telling their members what to do and which legal to use. All this because the parking industry is very shaky and nervous about the new code of practice which has been put on hold for the moment due to the parking industry objection.

I think they were about quite a bit a while ago, but seem to have died out perhaps0

Thought we'd heard the last of them, but have reappeared on the BPA AOS list, and here we go again!Please note, we are not a legal advice forum. Evening all,
So Spring finally emailed back, at 22.20 of all times! Saying
In order we can assist with your request, can you please advise the PCN number or number plate the SAR relates to?
Bit of a joke really. Now is this a case of them not being able to find the pcn, despite having all details to then try and pin more charges etc. Or, is it a genuine question and they need that information to assist do we think?
Either way, it's taken so long to get any response from them, that getting back to them probably means waiting even longer to hear back!0
