Judge wasn't impressed at all that Alan from Spring Parking hadn't bothered turning up and had put in his witness statement that he might not be able to make it, especially as I had made it clear that I wanted to cross examine him and that we don't know what he actually does for Spring.
It was dismissed on the grounds:
That my contract to park was with my company and not with Spring Parking
The signs failed the Beavis test as nobody could read them, even in the photos
I had to go through a secure gate to be able to actually park there
As I had permission to park by company, it is reasonable for me not to have to read the signs as I already have permission
The fact nobody knew who the landowner was and who had signed the agreement, and that Spring had provided a redacted version rather than the court one.
That it took so long to reach this stage and that they kept piling on interest
Also getting costs back, only 130 but better than nothing!
Yay! Well done you.
They tried to get over £350 from you, what with the added hearing fee and including disproportionate fee and 8% interest and ended up spending over £100 on a solicitor and were ordered to pay £130 costs to you.
What a thorough Judge to go through everything like that. Very good stuff.Unusual for DCB Legal not to discontinue a single PCN case.
Maybe Spring Parking aren't so keen to drop cases as they are smaller than the big ANPR firms. We can now signpost people to read your WS for Spring Parking cases and copy from itPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

All sorts of possibilities.Maybe trying to get a court claim victory so they can quote it on future threatograms and/or obtain a transcript.
Signed up to the DCB Legal scheme but insist on going all the way to court, no matter the cost (remember they go to trade shows like Parkex and have a stand to try to sign up new PPCs).
Or, going by Alan, they're a just bit inept.
