Just checking  -  Para 12  -  "Record of Struck-Out Cases for Misleading and Insufficient Claims by Parking Firms: (See Exhibit 01)..."

    In view of C-m's comment  -  "
Don't waste pages and the Judge's time on hopeless arguments that don't match your case.  It will annoy the Judge. That also means going through and removing later commentary about 'poorly pleaded POC', such as para 32vi."  -  should this para (12) and exhibits be in WS?

Check exhibit numbers in list are same as referenced in body etc. of WS.

A heads-up  -  in this context there is no middle "e" in "Judgment"  -  Google CCJ.

Para 37  -  "Given these deficiency....." is the grammar correct?
  • I wouldn't tip them off about the missing exhibit.  They could then quickly put it right.  Keep your powder dry and pounce at the hearing.
Perfect thank you. I haven't mentioned that there appears to be something missing, just that the signs are ineligible in their own witness statement. "The claimants own witness statement photos support this notion that the signs are blurred and ineligible, in which I refer to their own Exhibit 2."

On a side note though, surely they couldn't then resend a witness statement to the court and say whoops I forgot something?

Thank you, have removed Para 12 and exhibits from that.

Changed judgment and checked grammer of para 37.

Para 32  -  "Inadequate Signage and Unclear Contract Terms  As stated in paragraphs 7-8, The lack of adequate signage....."

    Those para numbers need amending.

Did you mean illegible - i.e they couldn't be read?

  • Hi All,

Again thank you so much everyone for all your help in this. Is there anything I should add/amend or do we think this is good to go? In which case am I best leaving to submit the day before witness statements are due or just to get it off now?

    Thank you!

Sending your Witness Statement early allows the Claimant to pull it to pieces when writing theirs.
Leave it as late as possible but do not miss the filing deadline.
  • Ok great. I've received their witness statement. Deadline for WS to be sent to court is the 5th, as court is the 19th. So will send on the 4th which gives 24 hours incase any problems sending etc
