    Quick update. DCBL have emailed with the usual "we would be prepared to settle at a reduced rate blah blah blah. Have also now been sent through my court date appearance which will be in in November. 

    My question is, on page 2 it doesn't actually say when a witness statement needs to be prepared by. It does however say " Unless the claimant does by XXXXam/pm on the XX of October 2024 pay to the court the trial fee of £27 or file a properly completed application for help with the fees, then the claim will be struck out by the same date as above and, unless the court orders otherwise, you will also be liable for the cost which the defendant has occurred"

    Should I from that statement wait until the X date before preparing witness statement unless I hear otherwise? Strange that there is no "you must file witness statement by X" on the letter

    Are you sure about that, not even something like "each party must send to the court and each other, such documents as they wish to rely on, at least 14 days before the hearing date"?

    So upon reading it again (As it is a joke to read as it's just a massive block of text) it says what you've said there, just not made very clear

    The deadline for witness statements to be sent is 12 days after the court fee needs to be paid

    Leave yours as late as possible, but without missing the court's deadline, to see if you receive the Claimant's WS, which you can study and take apart any misinformation, building that into your own WS. Sometimes it happens, sometimes not. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Just as an update, I'm going to start preparing my witness statement. I have just emailed DCBL legal asking for their notice of discontinuation before time is wasted preparing a bundle
