Adidas threatening letter

  • Hi everyone, I too have received a couple of letters from DWF on behalf of Adidas, the first letter wasn't very demanding just asking me to pay money they claimed I owed with no proof. I replied back to them via email with the email I received from Adidas which clearly showed "we have received your retuned items"...
    Then about 3-4 weeks later received this letter (pictured), as you can see a little more demanding, seems they're using the fact that the tracking shows "returned to sender" as proof I owe the debt.... I never received my parcel back and this was from a year ago. Royal Mail basically said to me it isn't my problem and Adidas had up to 80 days to claim compensation back through them which obviously has now passed. I used the pre paid label that Adidas supplied me. Any advice please, thanks

    Hi Amy,

    Ignore these letters as previously mentioned. They have a set of templates they use and each letter will differ. DWF cannot take you to court, only Adidas can. They can threaten court as much as they would like to scare you into making a payment but they have no legal parameter to do so. This is all bluster and empty threats.

    If they had any audacity to convince Adidas to escalate this to court level, they would have to provide all the evidence under the sun to prove they didn't receive the items. It appears as thoguh the evidence is very much in your favour should this ever get to this level (not that it will). Adidas have had a compensation window to claim from Royal Mail, they've missed that and you as a consumer are not liable for that. You've done your job by returning the items.

    Destroy or file the letters, they're a waste of time and don't let it stress you.
  • Just received another letter stating if i dont pay in 14 days they will take court proceedings, this one is alot more threatening. Dont want to pay for what i returned. So at an ends of what to do, any ideas

    I got one just saying I had not responded today, even though I had emailed them previously. But it just asked for payment. What did yours say if you don't mind me asking?

    It’s worth remembering that DWF specialise in mass mail campaigns. All of these letters and emails are just a mass mail merge each time using different templates.

    they aren’t taking you to court. They’ll either say it ‘May’ go to court or they’ll request their clients instructions to begin court proceedings, which won’t happen. They haven’t even bothered to provide any proof.

    these are mass scare tactics, do not let them win. They would get laughed out of court with zero evidence.

    You can either ignore it or go to DWF and deny liability and request proof of 'debt'. They must prove that you didn't return the order for this to be valid (which it isnt). More than likely, youll get ignored by them and theyll send you another letter or email saying they've had no response etc. As I've previously mentioned, this is all sent en-mass and is borderline spam.
  • Looks a bit like the ebay scam to me. Pre-print label stick a change of address over the top to somewhere else. The tracking shows as delivered, and customer is refunded
