    Shall I ring mediation and tell them not to bother setting up a appointment 

    I don’t want to get into trouble for not being in contact 

    so do I really just sit back and wait for excel an thrn if it does go to court do I present evidence

    You present your evidence as exhibits ion your witness statement. When the date for the hearing is listed, you will also be told when you need to submit evidence you wish to rely on. This is normally not later than two weeks before the hearing.

    I am feeling more positive I’m going to make notes in all what you have told me what rules excel have broken and I’m going to call mediation then wait

    Iv called mediation to tell them Iv declined and want to go to court and they said they will update my case and now just wait for court 

    I am away 7th-16th April , what happens if my court date is in that period , I told mediation so I’m presuming the N180 form will go to court and they will see I’m away

    I doubt a hearing will be that quick but did you state on your N180 that you were unavailable at that time?  If so, yes the local court will see your dates.

    It won't be!  As that's less than a month away. You still need to wait for their Reply To Your Defence and then after that comes the witness statement stage where both parties are given a one month window. 

    A brief timeline ....
    My small claims court hearing took place a year to the day of being the small claims court papers being served on me which is about average which was March 21, then the N180 forms were in May, then ot was their Eeply To Defence in August, then Witness Statement in November, date allocated in Dec, then case took place in March. So it won't be within weeks.

    Thank you , They sent this on the 15/03/22 and I sent the N180 form a few days before I think , will I receive anymore from excel now
