    Looking at the photos you have provided on your 'temporary' thread, if the actual particulars of claim are for not displaying a ticket, I reckon you have them cold. You show a sign which says in big letters "You do not have to display your ticket" !

    Remember, any confusion is supposed to be ruled in favour of the consumer

    If they offered a settlement that is usually a sign that they are not confident in their case.
    Iv been to Wigan today and got the pictures and it clearly states do not have to display ticket but on the machine where u enter your registration it does so very unclear and also the green button isn’t the button that gives u a ticket as I found out today

    They’ve not lost money as I paid for my ticket , I spoke to one lady today who paid and got a ticket but got a fine through post weeks later but she paid it as she didn’t have the ticket in car anymore to prove she had one so they are just trying to rip people of even when they have a ticket

    How do I let excel know I have the evidence , I’m going to ring meditation later and decline mediation then do I just wait to hear of courts or excel

    If you were to pay these scammers, according to an MP in the HofC last year, your money could end up in the hands of organised crime.   Do you rally want to fund modern slavery and people smuggling?
    You never know how far you can go until you go too far.

    DON'T!!!

    Let them waste their time and money chasing this!  Sit back and relax. Let's see if they are stupid and greedy enough to push it to court (which they'll likely do).  If they do go this far then good as you've got them by balls (with the inclusion of your physical evidence) and you xould come out if this with a compensation payment from Excel when a Judge strikes it out for sure. Excel have had to pay loads of their victims!  I

    t's like a game of cards, you have the better hand. So sit on your cards, wait and see if they fold or want to raise you then hit them with your aces!  😉

    You won't really need to disclose any real evidence until it gets to the Witness Statement stage. 

    Key things I've spotted/ points of note...
    • The PCN was incorrectly issued so therefore they've obtained your details from DVLA under false pretences so therefore have committed a Data breach which has been further cemented by them sharing this infk with third parties.  Its not PoFA compliant because you followed their rules! 
    •  Because based on their signs you've complied and therefore any PCN for noncompliance is a void so it should never of been issued much like that lady you mentioned who paid. And countless others who have been ripped off!
    • They may argue the machine says you do display, but the fact that the sign says it Trumps the machine label   the sign is effectively the "contract" of which complied with the terms of.  So you've got them on Unfair Terms and Data Breaches.
    • They have royally screwed up!  I'd expose this Scam on any local Facebook groups for the area to warn others and also the local MPs and Newspaper for the area.  Trading Standards should also be made aware. 

    • If they do and mention the machine text- I'd shut them down with the fact that the machine is dirty, the clear perspex is scuffed thus making the text inside hard to read.

    • On the big sign/ "contract" it  says "you do not have to display a ticket" and then further says - Any breach of terms will result in a PCN - but have issued you a PCN for compliance!
