Excel parking !!!

Hi 

I’m hoping someone can please give me some advice
Excel parking services have issued me with a £160 parking ticket when I paid for the ticket in the day in question 

I know I paid for it as I had to enter my registration into the machine and I paid for the required time , it stated you do not have to display a ticket and because I entered my registration I didn’t do this thinking they have got my registration they will know I have paid 

They are now claiming I owe them £160 because I didn’t display a ticket which with there signage which is unclear and Tony an that had a million an one things stated I only seen you do not have to display a ticket 

it went to county court , money claims and I have defended myself and have been given the option to have mediation as I’m not paying for the debt , now excel have received notification that I’m defending the claim they now want me to settle out of court an elms are not acting on there behalf now and they would like me to resolve this out of court within 14 days £185

please help me I’m out of my depth knowing what to do next

If you go to the NEWBIE sticky announcement on the first page of the forum and read the second post it will tell yo all you need to know about this stage.  Find a section marked IMPORTANT - KNOW WHAT YOU MUST DO AND BY WHEN!   There are a couple of links to follow for your help.  What did you put in your defence?  did you send it be e-mail to CCBC or did you fill in the tiny box on MCOL.  Everybody gets the Elms letter, everybody gets the "settle out of court" letter.  Do NOT accept mediation.  Have you received your DQ - N180 form from CCBC?

It cannot be for £160, it is capped by law at £100.  Have they added an unlawful £60 for debt collection?i

They are now claiming I owe them £160

You owe them nothing unless a judge says so.  Please read the newbies and complain to your MP.  If you paid for the parking they are very unlikely to win a court claim imo.  Judges are not fools.  They see these scams everyday.i

This was my defence, I’m from Manchester an I was visiting my godmothers pub in Wigan so this is all I had as my defence unless I drive to Wigan to take a picture 

I deny this parking ticket as it has been wrongly issued

On the 17.09.2021 I arrived at the car park as I was visiting my godmother who was the landlady of the ukelele pub on Standish gate

She gave me the money to pay for my car park ticket so I know fully I paid this 

I went to the pay an display which had insufficient signage and what was there was poorly lit the signage was not bold enough

All I could see was how much an hour it was an you have to enter your registration an then pay an press the button , it stated as o  YOU DO NOT JAVE TO DISPLAY A TICKET AS when you put your money in you put your ref, the signage was difficult to read an I deny the charge as I paid the car park an have been wrongfully fined 

The car park company should have lighting an have there signage more clearer as I didn’t see where sit said you have to display ticket 

I filled out the 1st court paperwork and I have agreed to mediation the N180  because I was scared if it went to court as I would have to appear an I’m disabled an have anxiety / mental health issues

Iv now had a settle out of court letter from excel this morning for£185

I’m guessing they have as I was ignoring letters as I paid for the ticket on the day , Iv said yes to mediation as I was scared , so do I have to definitely try mediation now ?

They prey on people with anxiety issues. Don't let them get you down. Plenty of people here on your side. First thought, you say it is your godmother's pub. Can she just pop outside, photograph the signs and send them to you ( and then here) ?

If your godmother is the landlady of the pub and it is a car park attached to the pub, get her to cancel it with the parking company.

She was she left at Xmas to go to another pub , I normally parked on the private parking nxt to the pub but had no room so I had to park on excel car park , she had to give me the money to pay for the parking as I had no cash on me so I know I got a ticket 

if I agreed to mediation what can I do other than agree this settle out of court which I do not want to do as I got the ticket it’s so frustrating what there doing to me I’m scared my anxiety is out of control at this point

Do you have a date for the mediation appointment?  You do not have to accept the outcome of the mediation, you do not even have to accept mediation.  It is usually someone trying to bully you into paying.

No I sent the N180 form off yesterday accepting mediation because I was scared of going to court 

Excel have sent me a letter this morning about settlement as they now know I responded to court letters so they are trying ti bully me this way now 

I’m sure I have to pay a hearing cost tho if I don’t accept outcome of mediation 

what have I done 😢😞
I honestly do not know what to do nxt can I withdraw from mediation before it’s all arranged an go to court ? Or do I tell excel I’m not settling from there letter

I still think that there are ways to beat this, and would encourage you to try not to be anxious. If this mediation is by phone you could go along with it, which makes you look sooooooo reasonable Just do not get talked into paying. 

Have you tried Google street view to try and get images of the actual signs?
