flopstocks said:Umkomaas said:Have they offered a further appeal to the IAS?But, because, because of furlough (we guess) parking companies are struggling to respond comprehensively to an appeal to the IAS, so we are now suggesting chancing an IAS appeal, packed with plenty of evidence. While the NEWBIES FAQ sticky, third post is POPLA focused, there's no reason you can't use lots of that to draft a 'kitchen sink' appeal, then letting the PPC deal with IAS in trying to put together their response. They might throw their cards in, no guarantee, but if you don't try it won't be otherwise cancelled unless there's a landowner intervention or a Judge does it.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

They state that if I appeal to the IAS I lose the chance of the reduced £60 charge. Am I better off cutting my losses and stumping up to £60.

Not our decision to make , we give advice and facts on the options available
If you decide to fight , the claimant has 6 years to issue a court claim pack from the CCBC in Northampton
Then you can put your case to a judge
Yes it is frustrating , but the new government regulated system won't come in until next year0 -

Either way £60 seems expensive and £100 is extortionate. But it could be a lot more if I end up losing the case 😞0 -

OK out of curiosity I revisited to car park today. Turns out the process involves pressing the green confirm button 3 times.
I did not press the confirm button after my Reg and leaving time were displayed. So my ticket was not printed, and after waiting the machine rejects the coin (I genuinely did not realise this). This explains why PPS did not see my payment.
I recently had case dropped by PPS at the court stage but I feel time around things are a little different.
The terms about displaying the ticket are clearly set out (and there is a telephone number should you experience issues getting a ticket). Obviously I should have read this to check everything was OK.
So I am now unsure if I can argue the case. I still think £60 charge for a simple mistake is extortionate but I guess that's now the world we live in.
Given the information I have provided, is it likely PPS will take me to court. At this stage I am thinking I might pay the £60, as it really my mistake.0 -
I still think £60 charge for a simple mistake is extortionate but I guess that's now the world we live in.It won't be by this time next year, if you stick around and get friends and family to do the Government consultation due out soon:
first consultation result reduced the cap to £50 (£25 of paid early) for most alleged breaches:
https://forums.moneysavingexpert.com/discussion/6252788/victory-for-motorists-mhclg-caps-parking-charges-at-50-80-in-london-with-mandatory-50-discount/p1
second consultation due in a few weeks, about the level of charges and (presumably) where the levels will apply:

Please come back to do that new consultation, whatever you decide!

Obviously I would rather pay the £25.
So I guess I now really have 3 options?
1. Pay £60
2. Appeal to IAS
3.Wait the for the usual debt collection stuff and attempt the new consultation.

Last time the consultations were mercilessly spammed by the parking firms and self-styled 'PCN debt collectors' desperate for their wedge to continue.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
