Received a ticket despite displaying valid permit

Quiet enjoyment is an implied term in all leases.
Look it up.2 -

It's also about what the lease doesn't say - for example if it doesn't say "No Parking without permit" you CAN park without a permit!2

Of course that will form my later appeal or defence but do I start off from the same angle with the landowner as it is not they who committed the trespass? I have told them they the are permitting the harassment and removal of peaceful enjoyment but I can't see the significance of this in requesting the HA request cancellation of the ticket by the PPC and I want to make my complaint to them as relevant as possible.D_P_Dance said:There you have it, read this

Just ask them to cancel it and do it quickly. Sometimes they have an agreement that they can cancel a few a month, or as long as it's within 14 days, etc. Stop overthinking it. Get on the phone to the HA in the morning and cry.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've sent an email detailing leaseholders' rights and their neglect etc after I was initially fobbed off of the phone. 24 hours before angry phonecall0

You say "then make the initial appeal to the scammers". Is there a correct order in which I should engage with PPC and DLVA/ IPC?Fruitcake said:An IAS appeal is risky as only about 5% of appeals are ever allowed. If you do decide to try it after your initial appeal has been rejected, then first make sure you use the free appeal service, not the paid for version where the decision is binding on the motorist.
Also follow precisely the appeal process providing evidence at every stage.
However, you are a long way from that yet.
Complain again to the landowner and MA, using the scammer's images compared with yours that show where the permit was actually placed.
I stress again, also make the complaints to the scammers, the IPC, and the DVLA, showing your evidence that the pictures were taken to deliberately omit the part of the dashboard where the permit was actually displayed. This is a clear attempt at deceit and an attempt to obtain monies by deception. The landowner/MA or whoever employed the scammers is jointly liable for this deception.
If all else fails, then make the initial appeal to the scammers. It would not hurt to show your images and theirs together.
I have exhausted the MA route and not approached the others yet, as someone from the MA seemed to express concern over the false ticketing and said they would speak to the PPC however when they were fobbed off "wasn't displaying a permit" that reply and the case fell to someone else in the MA who keep telling me it's between me and PPC.
Does this prejudice my case having an initial appeal to he PPC rejected by forcing me down a specific route i.e IAS? I note the Newbie sticky advises waiting for NTK for IPC members. Is this still valid as I have yet to receive one.

If you are within the 21 days from the windscreen PCN you could appeal now. If not, wait for the NTK but nothing will 'work' so who cares, really? You won't see any appeal allowed and you won't be paying. If you don't know this, and thought appeal was important, you haven't read enough IPC threads.PRIVATE 'PCN'?
