Dcb legal - letter of claim
Comments
-
So I have received a court claim today from county court. Total amount is now £515. I have no idea why it has gone from £310 then to £150 to this.
is it too late for me to go back DCB legal directly to sort out? Or do I now have to go via the court claim. If so can I dispute the amount their claiming?0 -

Do you really think that a company who could not organise light refreshments in a brewery can "sort this out"?You never know how far you can go until you go too far.1 -
What is the Issue Date on your County Court Claim Form?mummytobe3 said:So I have received a court claim today from county court.2 -

I have submitted an AOS already and realised I was a bit fast to submit as I could have given myself a few more days.
also selected - defend all claim0 -
I’m trying to put a defence together. Can I use DCB legal trying to recover double debt as a reason for disputing / not paying when receiving the letter of claim? Also it was from 2016 I don’t know if I was driving my car as both me and my partner are insured to drive when I owned the vehicle0

Just go to the front page of the forum and look at the standard defence template. It contains everything about double recovery and signage and all you need to do is alter the paragraphs 2 & 3.mummytobe3 said:I’m trying to put a defence together. No , use the Coupon mad template , double recovery has nothing to do with the pcnmummytobe3 said:I’m trying to put a defence together. There are a few recent court case threads on here where the possibility of several drivers has come up , please read a few ( everything has already been discussed , very little is new )1 -

I guess you filed an Acknowledgment of Service today. With a Claim Issue Date of 27th April, and having filed an Acknowledgment of Service on 28th April, you have until 4pm on Wednesday 26th May 2021 to file your Defence. That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.2 -
Thank you for coming back on this. Yes I submitted the AOS today.
im not confident on what to write on paragraph 3 as I submitted an SAR and they sent photo evidence of my car entering and leaving the car park on both dates. However I didn’t receive the letters as they were sent to my old address and only when I got the dcb legal letters was i reluctant to pay cos of the amount they added on.
they have also stated on my court claim form I offered to pay within 28 days but did not. This is not true. I took no liability for the debt they even come back asking for a reduced amount of £150.
I have a newborn baby and was pregnant at the time and I was not in the best place to deal with there requests or have the money to pay. Now I’ve received a Court form for £515.80
I really want a good defence email so I have every hope of winning this. Both parking charges were for Waterfields which is a retail park. As you drive in (Tesco) advertise 3 hour parking but apparently once you drive to the top of the car park it changes to 2 hours. I did not know this as the time nor see the signs for this.0
