    The BPA are the parking firms.  No wonder they voted to put a lawbreaking added 'cost' into the CoP a few years back.

  • so my MP actually helped with this issue in the end and they have come back basically saying I still owe the parking fines 
    This is what they said in part of the email......
    Each Parking Charge Notice remained unpaid. As such, contractual costs were applied to the balance. They were applied correctly in accordance with the British Parking Association (BPA) code of practice and will not be removed. Our Client has a period of six years to pursue payment of a Parking Charge (known as the “limitation period”). Our Client has made various attempts to recover payment before instructing ourselves to commence Court action and we have now been instructed as all prior efforts to recover payment have been unsuccessful’

    this has been going on since November and I’ve still not received a court order but it’s been threatened numerous times. Do you think they are still trying there luck? I could still receive one? Not only that we’re currently in national lockdown and a world pandemic I think it’s utterly disgusting they are pestering people in these circumstances.

    We see no let up in the number of claims by companies , possibly more so since the pandemic !  C P Plus have 6 years to issue a court claim , so some leave it until year 5  or later , in your case they could do so in 16 months time or thereabouts

    All the prelim sabre rattling is just words , smoke and mirrors , after coming here for 8 years or more I have found that the only thing that matters is what the judge says in court. We have seen many victims win in Court despite all the wild claims and bluster from these companies

    Personally I have no interest in their smoke and mirrors , weasel words from sc#mmers with little useful content

    It's all bluster until they get before a judge , where few of them seem to understand the basics

    You may not remove the alleged but denied contractual costs, but if you are foolish enough to incldue them in a doomed court claim, rest assured the court will remove them. 
    IN order for your client to reduce their costs they should remove them now, to reduce their filing fee.

    You will definitely get a court claim and they definitely can't add false 'contractual costs', which is double recovery and fully dealt with in our template defence thread.  You want to get the claim because you want to beat this scam and put it to bed this year, and you will.

  • Thank you for all coming back. 
    So I’ve now heard directly from dcb legal and they have made an offer without prejudice. The original amount being £310.00 they are now saying there client will accept £155.00 if paid by a certain date to prevent a claim being made.

    I assume this is them removing the contractual costs so if they did make a court claim I would have to pay this amount anyway?

    They may well add it, but the judge will take it away.  Have you complained to your MP?
    You never know how far you can go until you go too far.

    There are no contractual costs. There is the crap they have made up and added on top. Dont use that [hrase because you give it false legitimacy. 
    They really are absolutely desperate. 
    Usual loss in court is PCN (£100) plus filing , hearing and solicitor filing fee of £200 total.

    I suspect there's nothing 'scientific' in their calculation.  Their only calculation is 'let's throw a figure at her and see if she bites'. Often it's the precursor to a discontinuation. Hold your nerve.
