    It's NOT a "penalty" you see you get defensive when people tell you like it is then you contradict people that are helping you who do know what they are talking about!
    I told you that Park Jockey are useless they don't even know the difference between a charge and a penalty, they basically went into on line parking from software development.
    Hopefully they will cancel but PPC's are well known to carry on regardless, they will be contracted by the land owner not their systems administrator.

    We can assure you that park jockey are wrong when they said the word penalty

    Highview are not allowed to call it a penalty , a legal word that they can be reported for if used

    They can and do call it a Parking charge notice , they could call it an invoice , which is what it is , but cannot and must not use the word fine or the word penalty , you want advice and are getting a quick education in these matters , so you will know when it happens again, it may not be so easy next time !!

    It may be tough love , but you need to do what the rest of us have done , wise up

    So whatever they have called it , using incorrect wording , the main thing is they have asked Highview to cancel the PCN , that is the best option and outcome , providing it is done within a fortnight, ideally the keeper gets a written cancellation in the post , or by email

    Plan A , a landowner or managing agent cancellation is always the best option , it should always be tried , so well done on sticking with it

    There were 2 easier paths to get rid of this , the park jockey complaint , plus a keeper based appeal using just that blue template , either of which should have worked , or a good popla appeal at stage 2 if a code was provided , with our help and advice

    Yes it's like being back at school , but we have your interests at heart , Highview do not , Parking companies do not , so some people coming here have had years of harassment from parking companies , a steep learning curve and are very stressed over court cases, of which there are tens of thousands every year

    Don't be one of them , wise up asap

  • Hi redx, honestly I appreciate all of the help and advise offered and yes I am now more aware what to do if and when this happens again.  I am naive and think that answering an appeal with what seems to be a simple answer, I have learnt now that doesn’t work with these companies. 
    I have taken on board everything and will use this in future and help others too that are also not aware. 
    I am hoping they cancel it and we receive confirmation but I will keep you updated either way on what happens next x

    Who actually confirmed the cancellation?

    I have seen PoPLA decisions which have found against the PPC for using the word "penalty"  If goes against the  C of P
    You never know how far you can go until you go too far.
