Highview parking 😡

Hi fisher Jim, to be honest - no
i seem to be naive to this and have probably said things to Highview in my email that I shouldn’t have (like I’m insured to drive the car so what’s it got to do with them)
I appealed on the basis that I paid the amount the machine asked me to, thinking they would turn around and say it wasn’t my fault them and they would cancel the PCN but now they are asking for the name and address of the driver. I haven’t provided my address and don’t intend to.Shall I just ignore any more or there correspondence, tell them something else? or should I see what they come back with and follow the POPLA process which I am not familiar with?
thanks0 -
They will get the the address from the keeper records from the dvla(or whatever they are calling themselves this week). You told them you are insured to drive(why??). So they will assume (most likely correctly) you were the driver. They will then pursue you as the driver (even if you aren't the keeper) for the charge. Read and follow the newbies posts.apple321 said:Hi fisher Jim, to be honest - no

I’m so confused. I am not the keeper of the vehicle so what should I do now?0

I have to ask ... have you had a read of the newbies thread/discussion
https://forums.moneysavingexpert.com/discussion/4816822/newbies-private-parking-ticket-old-or-new-read-these-faqs-first-thankyou/p1make sure you start at the first page not lasteven if you only read the first post or so .... as in ... you do not need to read the court be just yet.The only thing that you can do at present is get a cancellation from the l;and owner / manager. You should be complaining to the Asda manager ... not customer services ....... and or the CEO . In this case they may not be able to cancel and if they say that ask them who owns the land.Ralph

If they can’t take me to court etc then why should I be worried about it, i have grounds not to pay as this was the fault of the parking facility, not my fault!??0

If you are not the keeper of the vehicle it's nothing to do with you , unless the keeper named you as driver ?
The insurance policy is irrelevant to parking tickets
The registered keeper should be dealing with this , not you , so who is the RK ???
Ps , they can definitely take people to court , within 6 years , a lot of them do !!!1 -
I am not the keeper and the keeper hasn’t named me, they passed me the pcn which I then appealed, and I didn’t look on this forum until Highview replied to me asking me for the drivers name and address (which I haven’t provided)
so what should I do now, I told them they are not having the drivers name and address and the pcn should be cancelled on the grounds it was incorrectly issued (as I paid the parking amount the machine asked me to and I provided my bank statement showing that)

They can take the driver to court. or .. They try the driver and then use PoFA to take the keeper to court. ... or just take any one they wish to court" i have grounds not to pay as this was the fault of the parking facility, not my fault!??"please stop this ... its not really relevant ... this is not the world of genuine companies like Lewis's that have customer service ... This is the dark murky world of private parking v... its that bad that even now the government is undertaking consultation as to how to change it.Have you tried the newbies thread yet ?Ralph

Yes i has read the newbie thread but the mistake I made is appealing before I read it!
im angry with myself but because I paid the fee the machine told me to and you can’t change the fee, the machine works it out for you!!
im now trying the contact the people who own the machines as it’s them that’s at fault here! 😕0 -

They can take the driver to court. Whether they will do so in the next six years is another matter.
Alternatively they could take the keeper to court in certain circumstances. Again, whether they will do so within the next six years is an unknown. Would the keeper be happy to go to court in that event, or would they rather this was sorted out now?
If the PPC does not know the address for service of the driver, then the keeper should appeal the PCN using the blue template, asap. PPCs have ways and means of finding where a person lives. They may already have enough information to do this using a tracing service. Again, whether they will do so is not known.
Please stop saying this wasn't the driver's fault. It is irrelevant, at least at this stage. Please just follow the advice already given.I married my cousin. I had to...I don't have a sister.
