Highview parking 😡

Hi, can anyone offer me some guidance please
im insured to drive this vehicle and received a PCN after parking in Asda car park. The PCN indicated I did not pay the correct amount for my parking duration.
The meter at this car park is one where it clocks you arrive and leave, you enter your reg in the meter and it calculates the fee you need to pay.
I paid via my debit card (£1.20, which is I guess for up to an hr parking), I was parked for 1 hr 10 minutes. I appealed the PCN, I provided proof of the payment on my bank statement (which came out of my bank the following day). I also stated that the machine had told me the fee to pay, I haven’t intentionally paid less!!!
I received an email response from my appeal and they have stated the following:-


“Thank you for your correspondence relating to your Parking Charge Notice (PCN)

The representations stated in your correspondence have been noted and considered. Please forward to us the full name and address of the driver at the time this charge was incurred so that we can update our records accordingly.

We are placing this Notice on hold for 14 days from the date of this email to allow you to provide the details requested.”


I emailed them back asking why they would require the drivers name and address to progress this?? And that the PCN should be cancelled due to the fact I paid the amount asked. How dare they??

Any advice would be greatly appreciated

    Is this an Asda exclusive car park, or a multiple use one?  Asda don't ordinarily contract with HV - ParkingEye is their usual preferred contractor. 

    HV are phishing for the driver details, which suggests possibly that they might not be confident about their Protection of Freedoms Act 2012 (Schedule 4) compliance to hold the keeper liable. 

    Unless you already have a POPLA verification code, sit tight and wait for a HV rejection with one included. 

    Prepare to deal with this at POPLA by reading and assimilating the NEWBIES FAQ sticky, third post, which shows you how to put together a strong POPLA appeal. The better prepared, the more likelihood of success.

    HIGHVIEW do not follow POFA so only the driver is responsible, not the keeper

    as long as you have not revealed who was driving, then a keeper (you) has no liability under the law named POFA , ideally you never say I PAID , you say the driver paid, or an occupant of the vehicle paid

    Ignore that and wait patiently for your appeal refusal and a PoPLA verification code.
  • Thank you. Because I have paid the fee for parking, and the machine is at fault as it only told me to pay £1.20 when it should have said £2,40 for example, why haven’t they cancelled it as it’s a fault of theirs and not mine. That’s my concern?

  • I basically replied to them with the following earlier, shall I wait there reply?

    ” Thanks for the reply, why would you need my name and address?
    I am insured to drive the car so unsure why you require this information in order to update your records or void this PCN

    I have tried calling and it says please hold for assistance and then cuts off!?

    I await your confirmation that this PCN has been cancelled”

    Some of these machines invite the motorist to adjust the amount shown. In other words a machine may show say £1.20 for one hour, but the motorist is expected to change that and pay the correct amount for the duration of the stay.

    Not saying that's the case where you parked... just a possibility.
    It's all about making money.

    shall I wait for a reply, if they don’t cancel it shall I ask for the POPLA verification code and then take it from there?
