Thank you for your reply. The bit I'm interested in most is the bit where they basically have my name wrong. Will a court throw it out for that? If so I'm just waiting for them to send the summons. I've sent a sar to smart but doubt I'll get a reply0

You told us earlier that it was just your initials that are wrong (and then only 'sometimes').
It is probably fair to say that you have been identified as the driver and such a small error will, on the balance of probabilities, not change you into an innocent man/woman.0 -

And apparently the PPC only get it wrong sometimes....malakai13 said:I'll give the facts of the case but before i do i want to ask if they have gotten my initials wrong on almost all of the letters I've had from CST, smart and the bullies DRP, will this case go to court or will it be thrown out?

Im waiting for court summons because i can't see what else to do the popla appeal has lapsed and ive received a letter before claim. Ill prepare the defence when I know its going to happen.
They have replied to my sar. Ill post their reply below. My email to them was very long so ill summarise. As the co op is closed I questioned whether they have the right to operate there. And also said about the charges on top.
Here is there reply:Good Afternoon,
In relation to Data protection and your rights to access, I am only able to provide you access to data that directly relates to yourself. In this instance any contract with landowners that we have in place, we would not disclose this to a data subject directly through this method.
In line with the BPA code we do have a relevant contract in place and can produce this as evidence to relevant authorities or bodies when needed to rely on it. Out side of these circumstances we would not provide this to yourself as part of a subject access request, as this is required to be retained to protect commercial interests.
The payment amount of the ticket are additional charges on top of the fine of the charge, and are administration fees, which is in line with BPA code of practice, and standard operation of parking operators, so is not unlawful as you have implied. This is detailed on the terms and conditions which would have been visible throughout the car park, and I have attached a copy of.
Please follow all the advice on the ‘Letter Before Claim’ that you have received, which will also provide a contact details to discuss the case in detail. I can only provide access to your data rights and therefore this is not a channel to discuss court or DRPL, therefore I can’t put your case on hold.

Im waiting for court summonsYou never get a 'summons' in the civil court. Stop thinking that you are somehow 'in trouble'.We have yet to see any CST case get to court. @BrownTrout reports some multiple ticket cases, but again, we've not seen them. Just concern yourself with the reality and come back if you get a N1 claim form from the Northampton CCBC. That's about it for now! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

We each have our views on this. Mine hasn't changed. Why would UKPC be instructing CST, with payments via DRP, when they are seemingly continuing to litigate via SCS? Just doesn't make any sense and we shouldn't be drawn into thinking that any of this CST guff should distract us!Please note, we are not a legal advice forum. If they are going to claim id say they will do it soon. They've lost a lot of money through the pandemic. How will my case hold up in court though. I can see a judge siding with the for 12 minutes when grace period for bpa is suppose to be 100
