I seem to be the latest victim of OneCom's 'services'. Last week I had a call from a person whom I thought was ringing from EE/Orange, as that's who my mobile service was with. Eventually it transpired that the person was from OneCom. To cut a very long story short, I was signed up as a sole business trader, supplied with a new phone that doesn't work for me (facilities are worse than my old 7yr old Nokia), transferred onto a Vodaphone network with a signal that is no better than the EE signal I had before (one of the reasons why I agreed to change services) and I gather I can not cancel the agreement of 36 months!!! I have written and complained, but what are my actual rights? Anyone know? I have quite a story behind all this, but it's very similar to other posts which I've already read. I feel well and truly duped by OneCom. Thanks0

Are you a sole trader ? Or did they set it up as a sole trader on the understanding it was supposed to be cheaper ?0

I am a sole trader as it happens, but I didn't specifically request that the phone be on a business user contract - they just said that they would set it up as such and me being naive didn't think anything of it. I didn't know that there were different Terms & Conditions for contracts of this nature and assumed that it would be subject to the usual cooling off period. I've never bought anything that wasn't. The Terms & Conditions were sent via email, after everything was set up. All very clever of them!It's not just about the money0

I'm not 100% certain, you would need to check, the Consumer Contracts regulations 2013 I think say you have to be given the T&C's first ....may be wrong but worth checking.0

There is no cooling off period in a shop. Therefore your statement is untrue.
Contract law still applies to a business. If you can prove you didn't get what was actually offered and accepted you have a case for the small claims court (sending a LBA first which may avoid the need to go that far). If not, it's your word against theirs. I believe the cooling off period (if a business contract) is of no help - there isn't one. However, contract law still apllies.0 -

Hi Vodafone representative,
I have had serious problems with one com having my account, giving me a new line and contract on it, however refusing to cancel it even though I called up and cancelled it within the cooling off period.
What are you going to do about it? they are also refusing to let my account be handled by Vodafone again until the contracts are up, why do you sell your customers details, including long term customers such as myself, to these cowboys!!
