  • After a bit advice if possible. I'm sure this isn't the first time Onecom has been mentioned and wont be the last. So I've been a Vodafone customer now for about 5 years and as a normal customer as my contract last came up for renewal last i contacted Vodafone to sort this. During this period approximately 2 years ago i was contacted by someone (who now it appears worked for Onecom) informing me he was my Vodafone account manager and walked me through my upgrade. My phone upgrade went through no problems and as i can recall to around 99% certainty as it was 2 years ago i signed up for a 24 month contract with an early upgrade option at 18 months. Didn't think to much further about it until the 18 month time when i call to upgrade and now all my calls to Vodafone are forwarded through to onecome (presumably my number is tied into their accounts) who now tell me my contract is for 3 years and i cant upgrade to a month before this time. I've scrolled through my emails from that time and have no confirmation and no letter confirming my contract length and more concerning is that all the perks i received with my contract all end on the 24 month end date which i had understood my contract to be ending. I have also contacted Onecom asking for a copy of my contract conversation so if i have signed up for 3 year contract which i understood to be 24 months i can at least put that down to my own naivety of not listening to the actual contract terms when they hang up and ring you back so as to not record the previous phone call however all Onecom have done is emailed me a copy of my supposed contract which has no confirmation from me that these are the terms i've accepted. Also when asking for a recording of where i agreed for Onecom to handle my account rather than Vodafone i have been told there wont be one as i don't need to agree to it only that somewhere along the line i have agreed for Vodafone to pass on my details to 3rd Parties.
Any help or advice would be much appreciated on how i can get some resolution out of this.

You had an opportunity to read the T&C that they sent you and to act accordingly.

Learn the lesson. Never ever agree to anything without seeing this in writing first. Especially if it's a cold call.

Postponed upgrade isn't the end of the world, but I would leave the scammers (Vodafone+Onecom) at the first opportunity.
  • Yeah I thought so. Own nativity but I put that down to thinking I was still negotiating with Vodafone and never having any previous issues with them still you live and learn. Couple of other questions, I saw somewhere that 36 month contracts were banned in the EU as of 2011 but couldn't find any more recent information to say if this was still the case. Also when finally managing to get through to Vodafone they now tell me I'm a business user which isn't the case. Wondering if there's any room for manoeuvre on these points. Thanks for the previous reply.

From memory Onecom set contracts up as business contracts without making that clear and the 24 month limit therefore doesn't apply.
  • Thought that might be the case. Will get back onto the phone to them stating the fact I'm 100% not a business user and see if that gets me anywhere. Also dropped a email to Vodafone as recommended in the pinned Vodafone post so hopefully Lee can get in touch with me to sort this out.
  • Hope you can help. I was recently contacted by Onecom, who offered a reduced monthly payment package and improved use abroad. I was comfortable agreeing to this, despite going on holiday the following day as I believed I had the protection of a cooling down period under the Distance Selling Regulations. I also expected a replacement handset as part of the package.

When I got back I queried this directly with Vodafone, who suggested I withdraw from commitment with Onecom and also that I was entitled to an updated phone. However, in contacting Onecom, I am told that my account had been set up for business use – which I feel was a deliberate action to mislead me into agreeing to a contract, where my statutory rights under the Distance Selling Regulations would be lost. None of this was explained.
My Upgrade- according to Onecom - does not entitle me to a replacement phone , even though Vodafone staff felt it should, as my contract was coming to an end.

To be honest for the first half of the conversation, I thought I was talking direct to Vodafone!

None of this is properly explained and I've made a formal complaint to Onecom, as the initial conversation was not helpful. I feel that they are acting in an unfair way and may be in breach of the consumer protection from unfair trading regulations.
    All help /thoughts appreciated. Thanks.

I doubt there are any new thoughts given that this has been going on for a LONG time and it's all on here.
  • This is still happening. December 2016. I have logged calls with Vodafone. Writing to Ofcom and Watchdog.

Call hijacked from a 191 call. Pressure selling. My wife who just wanted a new phone got caught up in it all.

It is quite clear this is going on with Vodafone's knowledge
