I think many are still  wary of whether the RCNs actually are covered by ATOL.  Particularly those who may not have no other options open to them to retrieve their money.

I haven't seen any updated advice since this

yes, in that case you would be, as the new holiday becomes your new contract.

  • Due to pay my balance on 1st May for TUI Cruise , unable to get through [ have tried 19 times within 40 mins today ]. If I cannot pay , are they entitled to cancel my holiday . Up to yesterday at 0930 their website stated , that when their stores re open you can pay then,, but 16 hrs notice it has changed to pay or we will cancel .
  • Think Im in the same boat as let-go-aft paid part of a deposit £150 due rest deposit £450 when shops open full balance due end Jul for holiday in august - dont whether to just not pay anymore - is there a risk they could sue me for rest of the deposit?

TUI cancelled trip on 8/4 (for 19/4). On 23/4 at 11:00 I asked for refund, processed while I was on the phone.  Midday cancelled email/refund confirmation arrived, following day it was already back on my c/c in full £4425, inc seat upgrades. 3 individual payments exactly as I paid.

I've a feeling that if you snooze, you'll lose!  Hope I'm wrong.

Strange mine cancelled before you on the 17 March, due to travel on 13 April 2020, refund awarded on 17th according to paperwork, (just under £2000) still nothing.  I was early, and still have nothing so not sure the snoozing thing is the problem!
Calling the number now just says they are too busy and hangs up ;)

    Possibly they could.
There is (or was) something on their website about being liable for the balance of the deposit if you have only paid the low deposit and cancel.
But who knows in these current circumstances.
But there is no record of TUI taking legal action against anyone (before that debate gets reopened).

    Personal opinion
I very much doubt TUI would  as they would need to proof they suffered a loss because of the breach.
If the holiday is cancelled  then there wouldn't be a loss and TUI might me forced to return any monies paid minus some fees.

  • If you paid for some of the holiday  and decide not to  pay the balance, you can always try to claim a refund of the money you paid.
Couldn't be sure if it would work,  but it would seem fair to do that.

Had an email today to pay the remainder of my deposit, with the balance to be paid 14th May, for an August holiday.
Am I better/ what happens if I leave it until the middle of May to pay in case we get any news over the coming 2 weeks. I don’t want to pay only to try and get it back again
