On top of what Bradders1983 has just told you, I doubt you would get any small claims court action until October at the earliest, possible even into 2021. Still, if it occupies your time at home go for it.1 -

It is as I have read it a bonus incentive of UP to 20%. So let's say total holiday cost was £2000. They will give a refund credit of £2000 plus up to a further £400 towards a rebooked holiday. So if the rebooked holiday costs £2400 it's all covered, if it's say £2100 it's also covered as this uses £100 of the incentive bonus but you don't get anything back ie the incentive bonus is treated as extinguished. If the replacement holiday costs more than £2400 then you'll have to stump up the difference above £2400.Mazzle said:Does anyone know if all bookings which are cancelled and given a credit note will also be offered the 20% incentive to book? We are due to go to Mexico for 2 weeks at the end of July. My partner is currently in a vulnerable group and the anticipated date of covid 19s peak in Mexico is mid August therefore we are highly concerned of the risk. We have paid our deposit and our balance payment is due next week. Please could you advise us on the payment of the balance so we don't lose the deposit (as the deposit alone was a lot of money to us) and would TUI really send us to Mexico if its peak is due in mid August whilst we are out there?0

How naive - do you really think it’s going to be that simple, based on how they’ve behaved to date? They are a law unto themselves, making the rules up as they go along. I simply don’t believe I’m going to get a penny back from them anytime soon.bradders1983 said:

You’re splitting hairs, a letter before claim is the same as a letter before action. They’re already in breach of the 14 day refund period set out in the Regs, and I’ve followed the standard pre-action protocol.bradders1983 said:

Everyone has no patience recently.
Patience doesn’t come into it, they’re in breach of contract and if it was the other way round and I owed them £1500, I very much doubt they would be willing to be ‘patient’.

Yes, go and clog up the court system why don't you! Court proceedings have ground to a halt, due to the fact that, you know, the social distancing and work from home directive applies to everyone - including staff who work within the courts system. Why do you think a refund "might not materialise?" TUI have never said that.2 -
If Mexico is "closed" then no, they wont send anyone. But if you dont pay the balance you lose the deposit. There is already a big TUI thread on this1
