Napier Parking - Waterlooville, Hampshire - Now BW Legal

A drive got a letter from Napier Parking dated 7th February as a FINAL REMINDER of a Fixed Charge Notice. This was for a small car park in Waterlooville, Hampshire. The alleged offence was the failure to display a ticket/permit. This occurred on the 15th of December at 14:29. They say they issue an FCN on the 3rd January at 11:55. The parking was paid for via JustPark App. Looking at the JustPark App The driver used for parking, however, They have noticed that the car number plate was out by one letter. So they have charged the keeper £90.00. The keeper went to appeal it directly with Napier Parking on the basis that The driver had paid for parking, it was assumed a simple and honest typo in the registration in the app. However, the keeper/Driver was out of the country when the FINAL REMINDER letter came the driver/keeper was unable to appeal it as the time for appeal had passed. NOTE The initial letter of the FCN was never received. 

The keeper has now received a letter from Napier Parking Dated 13th March (only received it 20th March) stating my account has been passed to their legal team, BW Legal and all communications have to be to BW Legal. They have also added the £60 (for Clients Debt Recovery costs) which as reading above is not legal. No response sent back to BW Legal at this moment and But have till the 27th March to pay. 

Do you recommend leaving it until BW Legal send another letter or should make contact (against the FAQ on this page) and state the above and also report them to the SRA?

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    Why would you deal with BWLegal until you get the 30 day letter before claim

    Even if you do get a letter, it will be 30 days to what ??? The lockdown will prevent BWL going to court for the foreseeable future.   Anyway if it does go to court sometime in the future, you can easily pop along to Southampton court where the spankings of BWLegal started regarding the fake £60 add-on and I don't think BWL will want to turn up for another spanking, even being sanctioned. Southampton court have made it very clear to BWL what they will do.

    Yes, nosferatu is saying EDIT your post as you should only use "the Driver" paid for parking.  "The Driver" might have mistyped the VRM (although how do you know it is not a faulty keypad?), the KEEPER received a PCN and all the letters.  Keepers have protection using PoFA drivers do not.
