Euro Parking Services and IAS?

Options
Me again.. sorry.

So, tried the 'asking the retailer to revoke the charge' but they Said they were not able to. The car park was insanely busy, with cars reversing and the only place to go was to reverse into the disabled space to wait for vehicles to leave. You can see the driver sat in the driver seat in the photographs! The passenger does leave the vehicle but the driver does not, though they stated that the vehicle was left unattended.

The images also so when a space becomes free but of course there are no photos that shows the congestion in the car park blocking where the driver could drive to get into the space that becomes available.

Also the timings for the period of parking differ by about two minutes on the NTK and the timestamp on the photographs. I thought this is something that I could use.

I have not heard of the IAS before, is that the same as POPLA? 21 days from 27/09/20 to appeal. I am worrying a little about this as I am seeing something about court appearance? Help please? :)

There is nothing to be done right now, if you've had a rejection from an IPC firm.    All you should be doing is complaining to the Head Office of the retailer, the CEO, and also reading Gladstone claim threads to see how these cases are invariably won at hearings, or discontinued.  As yours will be.

Have you missed post #3 of the NEWBIES thread all about the difference between POPLA and the IAS?  Please don't ask about trying that.  We are too busy and you need us at court claim stage, not now.  Come back to this thread then.

Sorry - head is all over the place. 27/02/2020 I meant!

Retailer - well there is a Tesco, which was visited after and a staff member stated that they have nothing to do with it. There was also a Greggs and access to another premises above those stores so there is no way to know which retailer. Maybe should try and call instead its a Tesco Express.

The driver did not get out the car, a passenger did whilst the driver waited in the vehicle 'reversed' because there were other cars pulling out of either the car park or parking space so that other occupants could get into it. Not sure this makes sense. The letter from Euro parking reports that the driver left the vehicle but you can see the driver in it. Not a good idea to have been in that space of course but there wasn't anywhere else to - probably should have left the car park and gone elsewhere.

It states that the vehicle was left unattended but it wasn't! The driver is sitting in the vehicle in the images you can see the driver.

Is it worth complaining to euro parking services?

They won't care , they have issued an invoice and want paying , they won't care about what happened

Any complaints go to the landowner or managing agent if it's a retail park

Just read this in another forum with someone who has the EXACT same notice in the same car park!!

They do NOT meet the POFA2012 schedule 4 para 9 reuqirements for keeper liabliity
This is becuase, at the bare minimum, they mis-state the relevant period - under "please be warned" they MUST give the period as 28 days starting the day after the notice is GIVEN, which means *received* by the individual> They instead say "issued", meaning they rob a minimum of 2 days.

Even if it's correct in your case , EPS won't cancel

Closure will occur in one of 2 ways ,
a landowner or managing agent cancellation
Or county court , where hopefully you will win
