Hi All, 
New to this forum and first time being in a situation like this.
So the registered keeper got a parking charge notice, notice to keeper from Euro Parking Services, the vehicle was not parked correctly within the marking of the bay or space. The driver admits this however had only stopped to use the cashpoint which had then taken his card hence the time at the location, duration of time at the location was 5 minutes whilst freezing the card via the online app. 
I have attached a picture of the letter that has come through however the registered keeper has missed the 14 day period due to being in the middle of moving property and has not been back to old address to check/read mail.
What step does the registered keeper need to take from here?
Does the registered keeper need to pay this? If not are there are any possibilities of receiving any CCJ's or similar.

    Appeal as keeper anyway , regardless of timescales
    EPS have 6 years to try a court claim
    If you lose in court , pay up within 30 days to avoid a 6 year CCJ affecting your credit rating

    Money is only owed if a judge says so

    In future follow parking rules when on private property

    They do NOT meet the POFA2012 schedule 4 para 9 reuqirements for keeper liabliity
    This is becuase, at the bare minimum, they mis-state the relevant period - under "please be warned" they MUST give the period as 28 days starting the day after the notice is GIVEN, which means *received* by the individual> They instead say "issued", meaning they rob a minimum of 2 days.

    Thanks for the quick reply, would you say this would be constantly chased as the registered keeper had wrongly parked, with the aim to eventually take to court?

    Who knows. They may dro pit/. not every ticket goes to court
    You will know to ignore debt collector crap. 
    did you read my response about the fact they cannot hold the KEEPER liable?

    the registered keeper has just tried appealing online, however due to the appealing time has been exceeded it no longer will let them appeal online. What do you advise to do from here on?

    Send an appeal by e-mail, keep a copy and a copy of the sent folder showing it has been sent; at least that way, if it comes to court, you can show the judge you tried.
  • Just confirming, the following is the email i should be sending over to them. Do i need to add anything further to the below.

    Re PCN number:

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    Your 12:38 post tells the world who was driving.

    Edit it to say that it was the driver that allegedly wrongly parked.
