    Isn't that the same thing??
    No because a defence is about the legal arguments , the WS comes later and I would have thought that you understood this by now

    As you can see in the subsequent replies , legal arguments are included to support your background information which is what it is and introduces more legal arguments into the paragraphs

    Normally network rail own the land and the TOC lease it , so a very strange setup , but either way it's not relevant land because bylaws apply

    Just a quick question,  on the Money claim website where i filled in the aos form, there is a file a defence form. 
    Does this need filing in as well? And where does the defence file go?

    No, put nothing in that box.  If you read the NEWBIE thread second post, it will tell you why and also tell you how you submit your defence.
    Refer back to a post on this thread written by @KeithP on 8th June at 1.43 and follow the instructions he placed there.

    The simplest answer is to read other court case threads on here , such as the KeithP reply on 3rd August in this one , so don't remain on your own thread , read twenty others

    Posted to help with others.....


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    Also in post #2 of the NEWBIES thread is full guidance on how to create a winning Defence and links to many examples of winning Defences.

    I’m just filling out the Directions questionnaire and was wondering about the court date.
    How does it work out regarding booking time off from work?
    There is a section regarding what days you are not able to attend, but that doesn’t include work I guess?
