So they haven't given up. Just received a letter saying the case has now been moved to a different court that is 20 minutes further away than my local court who isn't accepting hearings. I would have to use public transport to get there which would take me hours as well as taking my 5 month old baby who is exclusively breastfed. I'm really not happy about putting myself and baby at risk by attending this hearing. Can I write and ask for a postponement? What if I'm high risk and shielding etc?
Any advice greatly received.0 -
Oh I also forgot to mention. I have 3 other children that cannot be left on their own so how could I possibly attend this hearing at this time with social distancing in place as I can't take them with me? My partner is working so can't look after them.0

You have no option but to ask for the case to be postponed. Write to the court with a full explanation. They may suggest the case is heard on papers or a video/phone call which you must resist
I don't think any court can penalise you due to Covid. Right now, with the sheer number of idiots flouting the rules, you will never know who you are sitting next to,

As your case involves abuse of process by BWLegal, you can also add that a face to face in court would be suitable at a later date as you wish BWLegal to explain to the court why they have added £60 to their claim.
This may result in a judge striking out the claim for abuse5 -

So adapt the example I wrote on page 10 of the Telephone Hearings thread, weeks ago.
I also added another example to it last week about explaining why having young children at home means you can't even attend a telephone hearing due to not have a quiet room and not being able to leave them unsupervised.
