    Anything you wish to use in court must be seen by both sides in advance. If you attempt an ambush with new evidence it is highly likely it won't be allowed.

    Do I need to give them details of what I have or will “evidence on my mobile phone” be enough for now? I obviously understand I would have to submit details of this if it goes to court.

    Just saying evidence on your phone would be classed as an ambush. They need to know what you intend showing.

    You have to detail the evidence in your Witness Statement and x-refer it to your phone, just as if you were detailing written evidence and cross referring it to a printed document.

    As you're responding to a lba state you have contemporaneous, verifiable evidence on your mobile - get your friends to confirm if they have it as well! X that proves your vehicle was elsewhere, and backs up your 2 visits not being caught correctly. State yi7 will of course show this to court when required, and it means they have no prospect of any success at all.

    “Thank you for your email your comments have been noted.
    We have conducted an internal investigation and it has occurred that at the time of the parking event, there was a technical issue with the ANPR technology used at this site, therefore on this occasion will be cancelling this parking charge notice and request the debt recovery agent to cease pursuing you. You will not receive any further correspondence regarding this parking charge notice”


    I think me saying I had witnesses & “evidence” on my mobile probably swung it as they knew they wouldn't stand a chance in court! Bunch of Cowboys!!

    Now report them to the DVLA for unlawfully requesting your data and the ICO.
