    its ANPR , not APR

bear in mind the original SAR should have given NPE 30 days to reply , not 21 , they failed on both counts , so say so

Thank you Redx, very helpful, this is why I posted it here first as I knew I was bound to get it wrong! I wanted to make sure before sending it off!

Personally I think there is a little bit to much irrelevant information. Whilst you may be distressed by the debt collectors it has no bearing whatsoever on the fact you have made a SAR and they haven't complied.

I agree with the other comments.

Also, make it clear at the start what it is about, and give the ICO some evidence:

    Dear Sir /Madam,

My complaint is about excessive and inaccurate use of surveillance cameras by a parking firm, National Parking Enforcement ('NPE'). This firm excessively and negligently use unchecked data from ANPR cameras (or possibly CCTV) 24/7 at the NR2 hotel location in question and, in my case, they have used two out of four ANPR data captures of my car spanning two calendar days, to fabricate a PCN.

See attached PCN alleging wrongly that I was there overnight.

In fact the car left, then returned the next day. I dropped some friends off at the hotel in Norwich last year where they were staying the night & collected them the following morning.

This has now gone on for months and NPE know the facts and are aware that their data is inaccurate, yet they continue to store and process (and share with debt collectors) my data, to increasingly threaten me with escalating charges and court, for an event that did not happen.

See attached, my letters & emails to them & the hotel.

Also, see attached an article from an expert blogger who has exposed the faults with ANPR which causes two visits to be read as one, due to lack of manual checks and data diligence:

    http://www.parking-prankster.com/anpr-technology.html

    http://nebula.wsimg.com/07f5430a8d1c9bafced3dd1585f678f8?AccessKeyId=4CB8F2392A09CF228A46&disposition=0&alloworigin=1

Please also consider this document by the British Parking Association which explains that parking firms MUST make manual checks because this is a known flaw of ANPR systems when in the wrong hands, such as parking firms intent on misusing and abusing captured data to extort money from victims:

    https://www.britishparking.co.uk/ANPR

Here is how common it is in an article entitled 'Proof that ANPR cameras in car parks don't work' and again, NPE know this but have ignored me:

    http://notomob.co.uk/discussions/index.php?topic=5768.120

I wrote to them requesting a SAR in May this year explaining this was a double visit falling within the well known ANPR camera flaw, which has missed at least one in/out image in the middle, and made it appear the car stayed overnight when it did not.

I did not hear back from them at all & I thought that was the end of it.
Yesterday I received another letter form NPE again threatening court action against me.

See attached evidence uploaded. You can see I have exhausted their complaints procedure, if they actually have one. With IPC Trade Body firms, here is no truly independent appeal that exists at all despite what they say, so I doubt there is a proper complaints handling system either.

Can you please investigate why these photos carrying my personal data (VRN) have not been provided and what excuse NPE have for totally ignoring my SAR request? I would like them to provide machine maintenance records to show that the ANPR cameras have been checked as working properly.

I believe NPE are repeatedly abusing the Surveillance Camera (inc. ANPR) Code of Practice and the Data Protection Act 2018 by failing to control and properly record, store and check personal data.

My car passed the ANPR cameras four times, they are withholding two of them; the first exit and second entry the following day. I think this is unreasonable behaviour & harassment on their part & I am finding it very upsetting to be aggressively threatened with court action for something I did not do!

    Yours Faithfully

Obviously follow the steps to report a concern as set out on the ICO website!

Why do people always want to post things, letters get lost and you can't follow up easily or track progress.

I wrote to the ICO last week using Coupon -mad’s suggested letter (post #26 Thank you!) I haven't heard back from them yet (other than to say they had my email) but today I got a phone call from someone at CIS I foolishly took the call not recognising the name as another credit agency & thought it was to do with something else! Anyway, he basically said that I needed to pay the “fine” now otherwise I would be taken to court! I said I had no intention of paying for something that didn't happen & that I had witnesses to verify this. He then said this made no difference & it would still go to court -I said fine & hung up!
I am so annoyed that I didn't realise who he was straight away & thought it very bad to get even more hassle from them this time by telephone! It was actually quite intimidating & I can imagine some people would just cave in & pay up! I’m really angry about it all, I know there is probably nothing else I can do at the moment but just need to let of steam! Thanks for listening
