You are correct in resurrecting this thread
You appear to have yet another debt collectors letter
Ignore
The main thing is
Did you receive the reply to your SAR ?
If not , email another one to the DPO at NPE to get all of your data, threatening them with the ICO
Important , if you haven't received a SAR reply by early November , complain to the ICO , do not leave it unresolved0 -
Complain to the hotel manager, and CEO if there is one, pointing out that your data has been unlawfully obtained by their agents, and you hold them jointly liable for the harassment and demands for money with menaces to which you have been subjected for months.
You require them to cancel the PCN and confirm this within 14 days, or supply the name(s) of the witness(es) they intend to send when required by the court should this matter get that far in accordance with Part 33 of the Civil Courts Rules and Practice Directions.
Complain again to your MP about this unregulated scam.
If you didn't get a response to your SAR, complain to the ICO. I wouldn't bother about warning them first, they know what they should be doing to comply with the law by now.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
Complain on the Hotel website, TripAdviser, trivago, hotels.com, booking, com, Facebook et al. Write again to your MP,
There is no way that the scammer can win this in court imo. Challenge them to take you to court and tell them you will be seeking unreasonable behaviour costs and/or counter claiming for harassment.
IMO you have been a tad passive, show them that you are no milquetoast. You never know how far you can go until you go too far.0 -
Thanks everyone! I haven't had a letter or email response from anyone SARS or otherwise!
I wrote to my MP twice but again no reply other than to acknowledge they had my email. He wont be getting my vote & next time they come door knocking to get support & I will tell them so!
The NR2 hotel in Norwich has 47 reviews on trip advisor & 32 of them are terrible! I have written to them 3 times & I honestly don't think they give a toss! I will try again pointing out the things you mention. I will leave reviews too on other websites even though I didn't actually stay there, people need warning!
I would happily take these all these scumbags to court if I knew how! I’m no pushover but I know some people would have been very intimidated by all the harassment I’ve had (since last November!) & paid up long ago! No way am I paying anything!
I’m going to write to the ICO but I’m not sure what address to send it too? Sorry if its obvious & I’m just being a bit dim!
Thanks for all your help Guys its much appreciated!Too much of a good thing can be wonderful!0 -
I'm dealing with one of these too. If you had witnesses in the car, then get them to write a Witness Statement to that effect and send them to NPE "to clarify" the issue.
My case is slightly different to yours but the principle (rubbish equipement) is the same.
I note you've followed the standard advice here and had no joy. If you do write to the ICO then the issue you want to ask them to adjudicate on, is the withholding of your personal information.
Suggest you ask the ICO to ask them to provide machine maintenance records to show that the ANPR cameras have been checked as working properly. Also ask the ICO to ask them to detail the checks they make to ensure they do not abuse the Data Protection Act 2018 by failing to control personal data. Just my suggestion but my PPC will have to jump through the same hoops.Unlike some here, I am not omniscient. If I am wrong correct me. I won't take offence.

Thank you. I’m not quite sure how much detail to give the ICO? Should I just give them an outline of my complaint & the fact no one has responded to me in over three months? Thanks, I just want to make sure I get things right!Too much of a good thing can be wonderful!0

Send a copy of that letter to the Hotel and cc in your MP, and the local paper, and ask the Hotel Management to step in before you publicise what is happening due to their chosen contractor, who they could call off at any time because the parking firm is just an ex-clamper, an aggressive and notorious agent who do not own the car park, provide zero service and should not be let anywhere near guests' cars.
Do all of the above if you want to prevent a court claim (defendable - no folding!).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That's all good advice.
To the OP, I would also tell the ICO that since your car passed the ANPR scameras four times, they are withholding two of them; the first exit and second entry the following today.
You want the ICO to investigate why these photos carrying your personal data (VRN) have not been provided.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -

Dear Sir /Madam
Last November I received a parking notice from National Parking Enforcement for allegedly parking overnight at the NR2 hotel in Norwich on xxxxx – this was not the case!
The car was being used to simply drop off guests at the hotel & collect them the following morning it was not parked at all, in fact the engine was never turned off! I have witnesses who stayed at the hotel who can confirm this.
I explained this to both National Parking Enforcement & the hotel but to no avail & I then stated to be unfairly harassed by receiving countless letters (I have a large pile of them!) from debt collectors & Gladstone solicitors threatening court action unless I paid £££
I wrote to them requesting a SAR in May this year explaining this was a double visit falling within the well known APR camera flaw, which has missed at least one in/out image in the middle, and made it appear the car stayed overnight when it did not. I asked them to reply within 21 days but I did not hear back from them at all & I thought that was the end of it.
Yesterday I received another letter form NPE again threatening court action against me.
Can you please investigate why these photos carrying my personal data (VRN) have not been provided? I would like them to provide machine maintenance records to show that the APR cameras have been checked as working properly. Can you please ask them to detail the checks they make to ensure they do not abuse the Data Protection Act 2018 by failing to control personal data.My car passed the APR cameras four times, they are withholding two of them; the first exit and second entry the following day,
I think this is unreasonable behaviour & harassment on their part & I am finding it very upsetting to be aggressively threatened with court action for something I did not do!
Yours FaithfullyToo much of a good thing can be wonderful!0
