Amazon left parcel with neighbours, they denied to have it

Hello Please need urgent Advice

My parcel was delivered to a neighbor by amazon, but they are saying no person with that name lives in that property and no body delivered the item
its a expensive Gaming Laptop
I was home that day and driver never came to my property he didnt even left a card
and amazon keeps saying this
( . In particular we have considered information from our records, as follows which indicate the item as delivered:
- the timed geocode stamp of the delivery location;
- information collected at the point of delivery; and
- the package weight and reported condition upon delivery. )

Hence they are insisting that item has been delivered and and now i need to find with my number and if i not amazon can only issue replacement or refund if i go only to the police station and file a stolen report
I went to Tottenham Hale police station
but was informed by police officer at the station that they wont file report and they asked me to contact Action Fraud Help line

When i got back home call back amazon they are saying they wont accept fraud report
and they are saying ( we are unable to accept reports filed with Action Fraud, as this is a reporting centre, rather than a local police force. )


and asking these information

- Name/Rank of the officer
- Name of police station
- Phone Number of police station
- Crime Reference Number )

    Try the police again but tell them you want to report a theft not fraud. Don't mention fraud. If that fails send a formal complaint in. There will be a leaflet telling you how at the station.

    if they have not delivered the item to you and chose to leave it with a third party then that is a risk the seller took unless you asked them to leave the goods with the third party - you should be entitled to a full refund as the goods are undelivered

    i have told them but they say thats how amazon deliver here is the original email

    If the issue isn't resolved after contacting local police, please contact us again and include a copy of the police report, crime reference number and details of the station where the incident was reported. Please note: to assist in obtaining a police report, we recommend that you provide a copy of this email to the police to help explain what has happened. We will then validate the report with the local police force in question; for that reason, we are unable to accept reports filed with Action Fraud, as this is a reporting centre, rather than a local police force.

    It was what police officers what told me whey they heard its with amazon , they said they dont take here and i will need to contact action fraud
    They said since its amazon they didnt took any report either and simple was told they cant do anything
  • Why do you think it was delivered to a neighbour? The email from Amazon says it was, according to their records, delivered to the correct address. Have I misunderstood?

    It was delivered to my neighbour in their property
    And they are saying he sign and showed id card
    And apparently for amazon a neghbour accepting a parcel is same as me accepting parxel
    As far as i know amazon drivers have asked me id card

    So Amazon have confirmed it was delivered to a neighbour? Just that their email you quote says it was delivered to the correct address - doesn't mention a neighbour.

    Remind amazon under the Consumer Rights Directive, goods remain at their risk until they come into the physical possession of you or someone identified by you as being authorised to receive the goods.

    You didn't identify your neighbours so the goods being missing is their liability, not yours.
    Article 20
    In contracts where the trader dispatches the goods to the consumer, the risk of loss of or
    damage to the goods shall pass to the consumer when he or a third party indicated by the
    consumer and other than the carrier has acquired the physical possession of the goods.
    However, the risk shall pass to the consumer upon delivery to the carrier if the carrier was
    commissioned by the consumer to carry the goods and that choice was not offered by the
    trader, without prejudice to the rights of the consumer against the carrier.

    Unless you commissioned your own courier - which seems unlikely given the seller.
